Good evening,

     I have been going back and forth with USCIS on the delay in processing our I29F. As you can see from our profile, it is about to have a birthday. Currently I have a request in to the Ombudsman for assistance. Today, I received the attached letter. I cannot say that I saw anywhere that I would be needing to give biometric info. Has anyone else received this kind of request, or can tell where it leads?

Well, just something to note, it says that you filed a I-130 (Petition for Alien Relative) in the case type, NOT I-129F (Petition for Alien Fiance). And it's showing that it's at VSC service center, and not the typical I-129F service centers of TSC or CSC, Texas and California. 

Did you send the right petition? Are you sure they have your petition information correct? It sounds like either the petition was sent wrong or they have input the petition incorrectly, but what ever petition they have, either by their fault or yours seems to be incorrect.

The above link goes to a much larger version of the OP's pic. You can see that it says I-130 for case type, and VSC as the processing center, instead of I-129F and TSC/CSC.

Only time I have seen on here that a USC has had a biometrics appointment for a petition has been when they have had a criminal record or they have had the same name as a criminal who lives in the same town as them.

Ash - I noticed that change, but did not think much of it. Our NoA1 and the transfer to VSC both say I29F. Trying to load a picture to the gallery somewhere, but I am not very handy with this site.

 

Illiria - That is actually what I was wondering. To make a long and twisted story much shorter, I was arrested and charged with a crime. After six months, thousands of dollars, and lots of support from family; the charge was dismissed due to a lack of any basis for the charge. I would assume that shows up on my "criminal record," and is why this is taking far longer than it should.

Agree here something is off. 

 

I-130 would not be for a K-1 visa. Is there something you are not telling with the story?

Is the application number the same on the noa1 as on the biometric form? 

 

Maybe someone with the same name was actually convicted for the crime you were arrested for but not convicted and so they need to make sure you aren't actually the same person. 

 

Alternatively uscis could have ballsed up again :-)

It could just be for them to do more background checking.

Do you check your status of your case online? If so what does it say and when was the last update?

You said you've had back and forth with USCIS, what kind of back and forth? Them just telling you to wait over and over? Because most people don't wait longer than 2 months to start badgering them, over a year is extreme for a I-129F even with a criminal (but dismissed) background.

Georgia16 - No NOA2.

Transferred from CSC to VSC 3/16/16. "the record indicates that office has jurisdiction over the case."

I have called the Help Desk, made and attended an appointment at the field office in the Twin Cities. Contacted a state Senator for help (her office received and passed on the same canned response I had been getting). Now I have a request in to the Ombudsman, no solid answer yet. I am drafting another request to both my Senators and the district Congressman for specific help now. Canned response I have been receiving: "The processing of your case has been delayed.  A check of our records establishes that your case is not yet ready for a decision, as the required security checks remain pending."

If the crime you were arrested for would have been an AWA crime if convicted or the crime a person with the same name as you did then the below would make sense, not much but I could see how they would have messed up. 

 

Transferred to VSC and requiring biometrics makes me think it's related to  suspecting AWA convictions and as fiancé is not listed as one of the kinds of petitions that should be sent to VSC in the event of AWA convictions then it changing to spouse kind of makes sense in an odd way. 

 

Gods I'm starting to see logic in their mistakes :(

 

This could all be wrong but at the moment it's all I can think of, having the senator and ombudsman involved is great. Hopefully they can ask pointed questions as to why you need to go for biometrics.

The first few months any time I called the Help Desk or tried to use the online tool, it was always I had to wait for the stated processing time to elapse.

7/15/16 - Submitted a Case Status Request.

7/25/16 - "Our records show that your Petition for Alien Relative (Form I-130) is currently pending adjudication. Your petition is undergoing additional security checks. We regret that we are unable to provide you with a completion date at this time. We apologize for the delay."

8/26/16 - Submitted a Case Status Request.

9/7/16 - "We have placed your case on a processing hold because the required security checks remain pending. Until we receive the results of these security checks, we cannot move forward on your case. We require the results of security checks before we make a decision on any pending case."

Sometime in September - Contact made to Senator Klobuchar's office.

9/20/16 - Response from Senator Klobuchar's office: "Our office received below response from the USCIS: Thank you After a review of our systems it was found that the above-mentioned petition is currently pending security clearances.  Unfortunately, we are unable to speculate as to how long it might take for this process to be completed.  As such, you may wish to contact our office periodically for the latest case status update."

10/7/16 - My response to the Senator's office: "Thank you for reaching out to the USCIS. That being said, I was hoping for a bit more information. My petition has now been sitting for eight months, while many other petitions filed at the same time or later have been processed and approved. I am asking for the Senator's assistance in obtaining specific answers to specific questions. Namely: What agencies is the USCIS waiting for responses from; is the delay related specifically to me or my fiance; and who at the USCIS is being tasked with pushing other agencies to resolve this matter. Please let me know if your office needs further information from me."

10/10/16 - Submitted a Case Status Request.

10/25/16 - "The processing of your case has been delayed.  A check of our records establishes that your case is not yet ready for a decision, as the required security checks remain pending.
We cannot move forward on your case until the security checks have been completed.  These security checks must be completed on all applicants who apply for the immigration benefit you are seeking.  We will provide you with a decision on this case as soon as possible after the security checks are complete.  Please contact the National Customer Service Center at 1-800-375-5283 if you do not receive a decision or other notice of action from us within six months of this letter. (Highlight mine, head explodes)

10/25/16 - Request for assistance sent to the Ombudsman's office.

12/30/16 - "The Ombudsman's Office has reviewed your request for case assistance and contacted U.S. Citizenship and Immigration Services (USCIS) regarding your case. 

Please be advised that in certain cases, it may take up to 60 days to receive a response to our inquiry. We will notify you when we receive information from USCIS."

1/19/17 - "The Ombudsman's Office sent a follow up inquiry to the U.S. Citizenship and Immigration Services (USCIS) regarding your request for case assistance. 

We will notify you when we receive a response from USCIS."

Today - Letter arrives that started this whole conversation.

(Also in there was a scheduled visit to the office in the Cities, and several phone calls. Can't find my folder with all my excess info at the moment.  =/ )

Hopefully those you have contacted can straighten this out as you weren't convicted.

I don't know if it was a typo by you, but you say that back in July they called it an I-130 and that's incorrect. If they have been calling it a I-130, Petition for Alien Relative, and NOT a I-129F, Petition for Alien Fiance then something is 100% wrong. A lot of these things are automated, if it's automating the wrong information it can be hard to piece back together the right information.

If it's just a typo then you're probably in never ending background checks, but if that's the exact wording from the July SR response, then you need to contact them and find out what kind of case they have you under.

I know I've seen people have other peoples alien numbers put on their info, people be on other peoples green card apps that arent' suppose to be, people getting mistaken for others, you may want to confirm that everything they have is 100% correct.
