My wife's interview at the Manila embassy (CR1) is Feb 2. When I originally sent the I-864 to NVC in August of 2016, I naturally sent my w2 and tax transcipt for the 2015 tax year.  Now that we're into 2017, I'm wondering if those documents will be recent enough for the consular officer? The problem is that I made enough in 2015 to qualify on my own (but only just), but not quite enough in 2016. I can use a co-sponsor (my parents), but they don't yet have w2's or tax transcripts for 2016. What should i do? Roll the dice and just go with I already sent?

I submitted my w2s and i-864ez last year and it included  w2 for 2015, 2014 and 2013. my spouse's interview was this month too and I did not send any thing for 2016. I don't think you need to update them. the interview date does not change the fact that the case was started in 2016 so i would not worry about it too much (imo). Just make sure to send her another i-864 signed with original ink for the interview ( some officers ask for it - in my case i sent it and they did not ask)

The only requirement for USEM is that you present the most current tax information.  Since you have yet to file, and that you have until 4/15 to file, then you are only required to submit the most current which is 2015 for your interview. After April 15 you must provide tax information for 2016.

Ok, thank you for your reply. How sure are you about this? If they do end up saying that 2015 isn't recent enough, they won't outright deny the visa, right? They'll simply say that we need to get a co-sponsor? How much of a delay would this cause?

That's kind of what I was thinking, so thanks for confirming it.

1. 100 % sure.

2. No, they will not deny the visa. You will receive a 221g pending your submittal of the tax return they request and nothing moves till they get that. Once they have it they will continue to process your visa.  Typically, your approval is pending until they receive your information you submit answering the 221g.

3. Most 221g's take about 2-3 weeks from when they receivce

You will need copies of the sponsor’s U.S. federal income tax return (Form 1040, 1040EZ or 1040a all are eligible to submit) and wage statements (Forms W-2). 2015 issue till April 15, 2017 then 2016 returns and statements will be required thereafter.

We submitted 1040a for 2015 we pass it already to irs.. we passed the 1040a to the embassy with receipt from 2go ...hopefully the embassy will gonna approve it :/ thank u for ur info.

Did you get a 221g? You shouldn't have a problem if your sponsor earns more then the poverty level for the size of your new family.

Yes im in 221g and its getting 3weeks this week already im waiting..my sponsor is fine they just ask for 2015 tax return..they ask legal evedence of not filing income tax for 2015.thats why we passed the 1040a.i dont knowwhen they gonna issued us ..its been changing the date of status but still in ap. Its been updating 4times already but not yet issued.i passed already the driver licence as proof of domicile,letter of explanation and the 1040a with receipt of 2go.bc that what they asking .u think thats fine already ?

No one can say for sure, including me, that you are going to be OK. That's up to the CO who is adjudicating your case. Just keep in mind that if your status keeps changing then someone is "touching" your record and that it is not sitting in a pile "dead" for now and that's a good thing.  We have seen approvals in 3-10 days, some 30 days and others can sometimes be 6 months or more.  Like I said, no one can say for sure about your personal record. Hang in there, you'll get an answer.

 

You're just going to have to have a little more patience.
