Yes, you can apply for your EAD befor AOS (if you came in on a K-3 that is).

2005 Married

I-485/I-130

12/06/2006-------Mailed I-130/1-485

12/16/2006--------Recieved NOA 1 (I-130 & I-485)

12/18/2006--------Touched I-130/I-485

01/20/2007--------Biometrics

05/10/2007 -- Interview, Approved!

05/22/2007 GREEN CARD arrives!!!

02/2009 - File to lift conditions

12/14/2006--- Mailed EAD App.

01/20/2007--- Biometrics

02/09/2005-------Sent in request to Congressional office for assistance with expediting EAD.

02/13/2007 -------- EAD Approved!

02/26/2007 - ------EAD received

Removal of Conditions:

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

My advice is: Don't try that!

I came with a k-3 and applyed for the EAD before the AOS ( on December 4th 2006) and what happened is that everybody that applyed together was approved, but me. It's being 4 months and no RFE has been sent and no response either. If I could go back in time I would wait and apply for AOS and EAD together.

05/01/07 - Another infopass, this time he talked to someone in California who said that is going to approve my case and that I'll have my card in 3 weeks.

It's an excellent idea for a K3 to apply for EA before they apply for AOS.

You do not have to wait for your wife's I-130 to be approved before you can apply for AOS.

Make an InfoPass appointment with your District or Sub office to ask about the status of your EA application. It's possible that the USCIS service center has screwed it up.

Why not just apply for AOS and include the EAD in with that? Just include the I-130 NOA1 with the application to prove that you have applied for it, it doens't need to be approved for your to apply for AOS (despite what the form may indicate).

I also think they've screwed it up. And I've been trying to schedule an Infopass for one month here in South Carolina, and I always receive the same message:"At this time, there are no information appointments available for the office in your area. Please try back again later. "

Someone told me that in one of the Offices here you don't need an appt, you just walk in and they will talk to you. That's what I am going to try now. I hope it works.

One reason would be that EA applied for on the basis of (a)(9) is good until 2 years from the date of entry as a K3, while EA applied for on the basis of ( c)(9) is good for 1 year.

True. However it seemed that the OP was under the impression they couldn't file I-485 yet because their I-130 was in process, which is why I posted that.
