Help!!! 

We filed our request to remove conditions in November of 2015. We recieved our notice of action and followed the instructions with everything. They sent us a 1 year extension and that was the last we heard from them. We have done check ins and they are still processing and it instructs us that they have received and are still processing. The one year extension expires tomorrow and again we haven't recieved anything!!!! Does anyone know what to do next???? I don't want my husband to be on an overstay due to USCIS failing to send anything! I have submitted an inquiry to the time taking longer than what it shows on processing time line but they won't respond for 3 more weeks according to the email. We have done everything correctly paid all of the fees (they cashed our check in 11/15) here it is over a year later and nothing

I would suggest booking an infopass appointment to get an extension letter and inquire on the delay.  My understanding of the timelines is Vermont is working on Dec 2015 ROC's, so this is pass your timeline.  Are you within your timelines to apply for your naturalization? Have you considered applying for your N400?  I have read that sometimes both can be adjudicated at the same time.

Just wanted to point out that just because the extension expires, doesn't put you into "overstay". As long as your case is processing, you're still a permanent resident.

The closest place we have to get into for an appointment is 4 hours away and we both work 50-60 hours a week. My husband is an over the road truck driver and is out of state. He can't turn a wheel unless he has an updated extension letter or GC. Ps. It's his company. 

We have done the inquire on the delay and they will back to us around 2/12. We don't have the money to go for naturalization as we have already paid for the conditions to be removed over a year ago and nothing. We are afraid the same thing will happen if we file anything else at this time (cash the check with no outcome) 

its horrible when you do things the right way and follow all of the rules and you still get stuck

We would have to have an updated Current GC along with another $725 to file the form N400. And we still have to wait another 2 mos before he can apply due to the timeline. It states on USCIS that we shouldn't apply for anything else as it will delay our current application. I did inquire on the delay and they said they will respond on 2/12

I filed December 2015 and have not received my 10 year green card yet. I made an info pass at my local immigration office and was given a further one year extension. I understand the long work hours and the distance being a pain , but you need to explain to your employer that once your one year extension runs out you are ineligible to work. The I-551 stamp to extend you rights to work, to remain in the USA and to travel for a further year is vital.

Thank you for the response, I need to get my husband back to the state before we can do anything. How long did you wait until you went to the local office? And how long did it take for you to get an appointment? 

We already had one extension. And they told us that they will not give another, just the green card

Did you have a biometrics letter? It sounds so weird to me that you didn't receive anything but the 1 year extension. My advice is make an appointment for your husband and tell him the date he needs to be back in the state for the appointment. You should get another extension as long as yours is expired or expiring soon. I would advice you as well to apply for naturalization that will make them adjudicate the naturalization and removal of conditions together.

Yea we did in 12/2015. We completed and complied. It wasn't until after that we got our extension. I will be calling tomorrow. I wish they had longer hours as I work the entire time they are open.

 I went to the USCIS website and schedule an info pass at my local office from there. The soonest appointment I could get was for 2 weeks time. It was on a day I work, but given that should I not go and get an extension, I could no longer legally work anymore, my employer swapped my days off at short notice.

 

When you and you husband sent your husbands application to remove conditions on his temporary 2 year green card, you guys would have shortly thereafter received your NOA1 which would extend his rights to remain, to work and to travel for a further 12 months while his application was pending for review... If you have not had any news on your removal of conditions within that year he will have to get another extension - This is his responsibility to take care of his legal status - Not USCIS, therefore you guys will need to make an Info Pass where they will extend his rights to remain, work and travel for a further12 months. This is called the I-551 stamp which they will stamp in his passport. My passport had expired, therefore they gave me my I-551 stamp on an official document. If heaven forbid after ANOTHER year there is no news (and the immigration officer I saw said she has occasionally seen this with pending Vermont cases - shock, horror), you simply go back a year after again and get another I-551 stamp :P

The several times we contacted them to find out why it was taking them so long and is there anything we should be doing to expedite they stated we are in processing and if they can't make the timeline stated they will mail is another extension. Still haven't received one. I asked if we should make an info pass appointment and was told it wasn't necessary because Vermont wasn't past their time. Vermont passed it less than a week ago.

Honestly... If his extension is about to expire I would just bite the bullet, make an info pass and speak to someone face to face. The info you are being given simply doesn't seem right to me. Hope yall get it all sorted soon

Just checked our field office no appointments are available in the next 14 days so have to check back on another day! Grrrr

Ahhhh.... now don't give up on that... when I first check 10pm one night there were no appointments, I checked the following day at 7am and BAM! loads of them available ;) Keep checking......
