I am US citizen and I petitioned for my wife back in 2014 and it all went well and my wife got her green card. 6 months later her mom got really sick and long story short we ended up moving from Alaska to Sydney Australia to take care of her parents. I got relocated temporarily back to the US late last year and my wife came to visit me, of course they took her green card. No big deal at the time because I didnt think we were coming back here to the US after the short contract in Texas. Just now my company decided to keep me here permanently :(. I am currently in the US with my wife, house hunting. My wife is on visitors visa and valid for the next 80 days. I am not sending my wife back to Australia just to re-apply for the green card by herself. I still have the old forms from the last time I filed the i-130, i-485 and so on. Do I just need to update all the info and transfer it to the new forms? Does she needs to do i-693 again? they should have everything on file still right? any advice would be greatly appreciated.

it doesn't matter that they have everything on file, she is filing from scratch again, the whole adjustment of status process,

 

she has to put her former A# and social security # on the forms, and do a new medical and maybe vaccinations if needed

Go ahead and file for Adjustment of Status. Unfortunately, the fees have increased this past December.

Do you mean your wife surrendered her GC? Not sure what you mean by take.

 

If that happened people are usually paroled in.

Did your wife travel on an Australian passport? She presumably boarded the flight using her green card, but did CBP let her in on VWP?

Yes they let her out on a VWP 3hrs later after series of interviews. CBP said that it's considered abandoning her green card and she can't be visiting. Anyways, we almost filling everything back on the forms, we'll be sending in the application in a week.

Yes she is with me now here in California and yes AOS is the easiest. About to submit her new application in a week or so.
