Hi everyone,

my fiancé filed I-129F petition back in August, 2016. It was approved by USCIS on September 30th,2016

 

I receieved a letter from the consulate end of November telling me that I am eligible to apply for K1 visa

 

While gathering all the required documents we were not aware of the expiration date of the petition. He was coming back to my country so I used this opportunity to wait for him to bring all the necessary documents I needed from him as the petitioner. 

 

We are now in the fourth month (petition is valid for four months) and my medical is scheduled for monday(that is our last step). However, we are just worried that submitting my documents for visa in the last week of the last month might cause problems . Will the consulate still accept our case or will we have to file the petition all over again ? 

 

Does anyone have experience with extending the petition ? Please help ! ?

As long as you have taken action on the petition, like scheduling the interview, I believe the embassy will auto-extend the expiration date.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

(if you are running late) Contact your embassy via email (what I did) and ask them extend it.

 

Our embassy received our papers "too early", in February, but we needed the interview to be no earlier than May (+6 months for our marriage plans). Embassy said that's fine, let us choose the date in May (26), and all went well.

 

I should mention that i-129f was expiring in June, so our waiting/halt was within the time frame, but I believe you should be fine too
