Obama care penalty.

I don't know if anyone has asked this question before, when i recently talked to an immigration attorney he said that he has never been asked this before and he needs to more research regarding this topic, so i thought i will put it here in this forum for anyone who has experience with this to answer . I have heard that Obama care penalty cannot be enforced via lien, collection , garnishment etc etc, but can only be taken from a refund unlike other tax penalties  , if Self employed couple do not get the refund then this would not be a problem , however if that self employed couple is in the immigration process , for example the wife will apply for N400 citizenship , will this Obama care penalty be treated as any other form of tax penalty and can her citizen ship application be denied based solely on Obama Care penalty even though if they have filed their taxes properly and do not owe anything other than this Obama care penalty to the government?

It is a penalty and would show as an amount owed on your taxes. If you are receiving a tax refund the "penalty" is deducted from there but if "penalty exceeds refund amount then you would be responsible to remit that amount. So yes it is a garnish-able amount and if you do not pay the owed amount it can and will effect your application. Yup that would suck. 

BUT that being said. 

 

This individual mandate it is NOT like any other penalty and can only be taken from a refund. If you never get a refund then you never have to pay it but if you were ever to get a refund it would come out.

This will not effect an immigration case as long as you file your taxes yearly and properly.

2017-02-16(Day 4): 1st NOA "went background checks are complete interview will be scheduled" no mention of Biometrics

2017-03-03(Day 15) Biometrics letter arrives scheduled for 2017-03-13 Might try a walk in earlier
