Timeline

My husband went to the DMV to day to take his test and they wouldn't process him because they said he needs to have a letter saying granted leave to stay while AOS is being processed. They wouldn't accept his K1 visa as it is temporary. Our AOS noa1 has come but we have no letter like that yet. She even showed him another person's letter. Can anyone give information on this that has gone through it?

PS I never heard of such a letter. NOA1 should be all the proof you need of pending AOS. That's all I had to show. However, it depends on the rules of the state, which is why I asked which state you were in.

We live in Missouri. Andre had to have his green card to get his social security card. Then, the DMV allowed him to apply for his permit. They allowed him to take the test, no problem. But, would not process permit without green card and SSN. Once those arrived, he applied for permit and state ID. He's planning on taking the actual driving test Friday.

Sounds like that is how it is there too.

Here is what you need to be able to show to get DL.

Only the original or a certified copy of one of the following documents is acceptable:

Valid foreign passport with a valid Record of Arrival/Departure (form I-94) - has to have 60 days validity remaining

Employment Authorization Card

Permanent Resident Re-entry Permit

"Processed for I-551" stamped in a valid foreign passport

Valid I-94 with attached photo stamped "Processed for I-551 temporary evidence of lawful admission for permanent residence"

Notice of Action (I-797 Approved Petition)

Hmm.... I checked here:

and it seems they are complying with the state's mandate, unfortunately. They do not show the NOA as acceptable.

It's what we used here in VA, too. Apparently the "show me" state should be renamed the "show me more" state!

Being an AOS pending applicant (or something...I'm too tired from work, probably shouldn't be typing :D) you have a right to stay, so I don't get why they need a letter. BUT some states want an SSN and/or green card but here in FL, M walked in with his three NOAs and they said okay ... reading online doesn't look like that is standard protocol. You could always try another DMV office and if they say the same thing, you're probably SOL until you find a way to get such a letter.

You can certainly try but we tried three different offices for my son and failed - California DMV is very strict about what they will accept.

Hope it all works out well.

It is a true statement in California, or anywhere else. NOA1 is all the proof you need to show that you are in pending AOS status.

However California DMV doesn't accept proof of pending AOS as evidence to get a Drivers License.

Dr_lha do you what PA likes and doesn't like in that respect? I've heard of conflicting stories, and thought you may know.

The NOA1 is not sufficient evidence for Oklahoma, you need either a valid EAD card (which would mean that the resulting DL would only be valid as long as the EAD is valid) or your green card.

We are in California and the person at the DMV said the NOA1 is not enough and we will get a letter saying that our status is pending. She knew what she was talking about and showed my husband a folder with a letter that said your AOS status is now pending and that the NOA1 is only a reciept that you have sent it and it was recieved. Anyone recieve such a letter that their AOS status is now pending??

The NOA1 is not sufficient evidence for Oklahoma, you need either a valid EAD card (which would mean that the resulting DL would only be valid as long as the EAD is valid) or your green card.

Once states get in line with the REAL ID act, NOA1 should be good enough. Right now not all states are in line. My state (Pennsylvania) is, California is not, obviously neither is Oklahoma. This should change when REAL ID becomes enforced, hopefully and all the States should be the same.

To the OP: I've never heard or seen of such a letter. Did the letter they show you come from USCIS? The only thing I can imagine it might be is the "Welcome Letter". Unfortunately I think you'll have to wait until you get your Green Card or EAD.

Flutter: Yes, in PA all you need is a SS Card and NOA1 to get a 1 year drivers license.
