This is due to my wife having been arrested before in the US... it is not that serious and according to 2 lawyers there will be no problem, but we had to submit a letter explaining what happened as well as court papers... that's what that is.

If your wife wants to work or travel, you should also submit forms I-765 and I-131

She has overstayed her B2 visa for 6 years, so no I-131 - and she doesnt have to work until her green card is approved, so we are passing on I-765 as well.

be sure to include a certified copy of the marriage certificate!!

A certified copy ???????????????? All I have is a copy that was sent to us by the county and I made copies of that. I needed something certified by them ?

I have to send one with the I-130 ?

why do you want to submit 2 pictures of yourself (USC)?

Oops...

ok on the I-130 itself, it says:

7. What Documents Do You Need to Prove aFamily Relationship?

You have to prove that there is a family relationship betweenyou and your relative. If you are filing for:

A. A husband or wife, submit the following documentation:

1) A copy of your marriage certificate.

and on the I-485, it says:

If you are applying as the spouse of that person, also attach a copy of your marriage certificate and copies ofdocuments showing the legal termination of all othermarriages by you and your spouse;

Doesn't require it to be certified.

Right, but having to choose between the 2, I would rather go with the instructions on the forms. :D

I will put it in the mail tomorrow morning... !

Wish me luck. Did you any of you kiss the papers before putting it in the envelope ? Lol.. I got caught by my wife kissing the papers and she was like :lol::lol::dancing:

Exactly... only reason why I will send just a regular copy is because it doesnt say on the forms it has to be certified. And worst case scenario I will get an RFE, which I know might delay the process, but I will take a chance.

It is weird noone has said anything besides you, after all everyone here is somehow adjusting status and had to send their marriage certificate... well, it might be because of the subject of this thread - not very attractive. hehehehe
