US Father refuses to give his baby daughter her US passport

USC Passports for kids are only good for 5 yrs. As your friends daughter is now 8 it is most likely expired.

5 years for the jamaican passport also. Maybe both pp had expired but you still need it to get a new one. If you report the Jamaican passport lost or stolen, you will need to report it to the police station for a receipt to bring to the passport office to get another one. This is complicated contact the us embassy in Kingston and see what they say the us passport.

She'll need sole custody or the father's permission to get a new US passport.  Maybe a threat of filing for child support would do it?

Technically a passport is owned by the government that issued it. 

 

Contacting DoS, explaining the situation, and reporting it to them as stolen would probably be my first step. 

 

DoS may be able to order the father to surrender the passport to them. 

 

Regardless, the consent of both parents is usually required to obtain a US passport for a child.

Of course.  All such forms/instructions to apply for anything of the sort from tax breaks to government benefits stipulate the rules for claiming a child.  Almost always, the primary guardian will get benefits, but not the non-custodial parent.

When u apply for a child they still need information about the old one and it is send in with the app. Both parents have to give consent if they are on the child birth certificate. So how is she gonna say it was stolen when the other parent has it. They both need to work together to get this child his/her passport. Sounds like they don't get along and are using this passport as a trap.

  He can only claim the child if he has physical custody more of the year than she has unless she agrees in writing to give the deduction to him.  Child support doesn't work both ways.  It Is based on the percentage of time each parent has the child and the relative incomes. 

This will not be over quickly. You will not enjoy this.
