I've been watching that 02/2016 list like a hawk for several weeks now.  I noticed that VSC is usually a month ahead of the posted processing times. For example, they were already processing January applications when the updated their processing time on November 30 but the "Processing Cases As Of Date" was December 14, 2015.

I'm glad that this has been brought up because I was thinking of asking here but I didn't want to sound ridiculous but I'm worried. I'm from England but my father is from Iran and my mother is English. I have never lived in Iran but by Iranian law, I am an Iranian citizen because my father is. I have had an Iranian passport (expired a long time ago) and have visited twice to see my relatives when I was 16 years old, 7 years ago. My maiden name is obviously Iranian and I mentioned having been there at my AOS interview because the officer asked me if I've had fingerprints done before and I said I had when I was applying for an Iranian passport. He was a very nice guy but it might be on record and I'm worried this will affect my application. I am not a Muslim and neither is my father (only in Iran are we labeled as Muslims because the government labels you as a religion but we are not Muslims or religious). Heck, I don't even speak Farsi!

Hey All,

 

I can't believe it's been so long! Quick question. My wife and I got married and she got her first card in May of 2014. That means her three years is coming up this May in 2017. I saw there is a 90 day filing rule where my wife can file the N-400 this February. Is that correct? Do we have to wait for the removal of conditions to be cleared before we file the N-400? Since the VSC is completely backed up, we obviously don't want to wait if we don't have to.

You do not have to wait for conditions to be removed to apply for the N-400.  I fear those of us at VSC are going to be waiting forever until we bombard them with N-400 applications!

I think they shut down the website or something. You can try to email them at  cisombudsman@hq.dhs.gov  include your I-751 case number, your alien number, date and time that you contacted USCIS by phone. Good luck to everyone :)

Like @Sukie said, you can file N-400 but I strongly suggest you make sure that all your affairs are in order before filing. I was all about filing N-400 as soon as I become eligible but I'm now thinking I may be better off waiting the extra month or two it might take to get that 10 yr GC. Here's why - based on what I've been reading it seems like they will not send you a 10 yr GC if you have a N-400 case pending. If you run into issues with N-400 it may cause lengthy delays and you may be stuck without an actual GC and not no naturalization certificate.

"Our Congressman's staff member got back to us and said USCIS told her his I-751 was indeed approved, as the adjudicator told us. However, they will not issue the 10 year green card unless he doesn't pass the 2nd interview because naturalization is still pending. "

PrivateOne - what do you mean about "have your affairs in order"?  My interpretation of your words means stuff like making sure your Driver's License isn't going to be stuck in la-la-land, or your job isn't going to be in jeopardy, or that you aren't from one of the 7 countries that T-rump has banned, or you aren't going to get stuck overseas when your I-551 gives out.   Is this what you mean?

Hi Sukie, 

Maybe "have your affairs in order" wasn't the right phrase / expression to use in this instance. What I meant was anyone who plan on filing while ROC is still pending should make sure there aren't any hurdles that may prolong their N-400 processing time. What kind of hurdles? Basically, you should pay attention to every item in the "Document Checklist" section on the M-477 to see if any of them apply to you. Forgetting to include just one item in a list of requested items can result in lengthy delays especially if the item is tied to the background checking process. Some of the documents requested in certain situations can take a while to process.

 

Hope that help clear things up a bit.
