I think the moral of the story is:  know the process and know how to defend yourself in the process.  I think that is what VJ does for all of us - it helps us understand what is going on in the background,and helps us stand our ground when we are questioned.

 

The delays at VSC will be unfathomable to some Border Patrol officers.  They may have never seen cases where ROC has taken so long - and they might question the stew out of it.  If we know what our "rights" are (I know we don't really have any - but that's the only word I can think of), then we can inform the very people who are questioning us.

 

Many Border Patrol officers get hoity-toity when they see things they've never seen before.  They try to apply a rule they know to a situation they do not understand, and they dig in when questioned.  Case in point:  a well-known and well-revered Australian children's book author, Mem Fox, was recently stopped on the West Coast.  She was coming in to speak at a convention, where she was receiving an "honorarium".  She was on the VWP or on a B1 visa, and the Border Patrol agent decided she was "working" on a non-working visa and was going to deny her entry.  After a number of hours (this woman is 74 years old), they finally let her in, but she was shaken and upset.  She'd entered the US on this visa to do the same exact thing many times before.  But the BP agent just got it wrong.  The US Consulate in Australia had to grovel on its knees to assuage the anger of all of Australia.

 

So...individual officers don't know all the rules, and they make mistakes.  Know what YOUR process is, and help yourself.

 

Good luck to all of us.  I know we are on pins and needles waiting for that magic letter!

Oh yeah, growing up in the border taught me how the system is not really a system, officers at the border know some stufff that others don't or other way around, and they tend to be less friendly, I'll give myself at least two hours prior to my bus departure, just in case. 

 

I asked if the officers there would be able to see what she is seeing in the system and she said yes but shrugged. I'm also thinking about the border patrol checkpoint. I know agents there see those documents more often than not but I can't help but thinking that at the end of the day, they can hold you for however long they may need to.

This has been an amazing journey. I found VisaJourney late in the process but still found lots of help and encouragement. I'm happy I got off the sidelines and signed up to be member. You guys are like family now. 

 

I've just completed another part of Journey. My ROC application was approved on April 8. Got the NOA in the mail just now. Envelope is dated April 11. 

 

I'll begin the next part of my journey soon. N-400 will go out later this week. I'll remain active in this April filers group until every last one of us gets a decision. I trust that it will be all approvals.

 

Still hoping to do a timeline...hope soon.

Timeline

Today, I received an RFE in the mail.

The letter states that they received our join tax reports from 2013 through 2015, joint bank account statement, auto and renters insurance having both of our name, lease agreement.

 

But they are asking for joint ownership of assets, joint responsibility for liabilities or an active commingling of finances throughout the marriage.

 

Since both me and my husband exactly do not own anything together other than bank account.

I will make a statement explaining that we rent apartments together, have both of our names on insurance and have a pet together.

As for the comingling of finances I have no idea what this is about. I will also ask my friends and family to write an affidavit for us as proof of our good faith marriage.

 

I am discouraged about this notice but will try to send all the documents by next weekend.

Hopefully they will respond quickly.

I can see how this may be discouraging getting RFE late in the process. You pretty much covered the same type of evidences I submitted with my application. I suggest you add the following if you didn't submit them before (and can get them):

- 2016 joint tax return (and or IRS transcripts)

- Credit card statements (if you share one)

- Health insurance in one person's name covering the spouse

- Those affidavits will come handy (at least 3)

- Most bills can only be in one person's name. It's ok to send some bills that are in one person's name and other bills that are in the spouse's name once they show the same home address and cover the same time period

- Receipts of large home appliances bought since 2013

 

Update all types of evidences you sent before to include those between April 2016 till present. As you mentioned, attach typed responses thoroughly explaining your plight. The RFE means someone picked up your case so your approval won't be long once you send in the response to the RFE. Good luck to you!

Thanks for the help... This is my plan.

I am going to make a letter head listing all the documents I will be submitting with.

- 2016 Joint Tax Return : Definitely I will include this in and as they advised me not to submit documents that were previously submitted, I will omit 2013 - 2015 returns

- Credit Card Statements : We do have credit card that we only use in case of emergency, but my husband is just an authorized user. So the statement is only showing my name on it. It's Bank of America.

- Health Insurance : Unfortunately, we did not put each other's name on our health insurance because both of our work were going to deduct more amount from our paycheck. However, I joined his vision plan this year because I didn't have any. So I will try to make a letter to explain the whole situation briefly.

- Bills : I actually did not submit any bills because they did not have both of our names. But I will definitely try this method. Thanks!

- Receipts of home appliances : We just moved into a new apartment and actually bought some furniture (under my husband's name).

I am also going to file my new lease agreement with the new place anyway, I will make another letter that we moved into a new place during the process of this application.

 

I do feel hopeful now, the RFE letter was quite surprisingly listed the documents that I sent them over to them.

Apparently, I only sent a month of our joint bank account, instead of the past 3 ~ 4 years. I will submit more bank account statements.

They specifically mentioned that they have my statefarm bills and insurance (it literally said statefarm).

 

I will complete all the details by next week and send them over.

Hopefully they will not put me into the interview process because both of my extend letter and the driver's license expires in June.

And there is no way I can renew my ID or get a stamp on my passport because it's already expired and the government of Korea wouldn't issue me a passport at all because I didn't service the military in Korea..
