Filing I 864

Hello guys this is my first post on this forum.

Thanks for answering my question.

I'm the intending immigrant and my wife and I have everything to send out our AOS package but we are having trouble filing the I-864 because she doesn't meet the guideline to sponsor me, so we are planning on using my stepfather as a co-sponsor (form I 864A) to combine her income to his, we all live in the same house in this case she will be his daughter in law. He can't file form I 864 by himself because he is under the guideline for a few hundred dollars.

And here is my question.

Can he (as father in law) file a I 864 A along with my wife I 864 and if he can what would we need to prove it. (Documents)

unfortunately no, if you read the instructions of the i864A, the household member has to be an immediate relative, if it was her dad, no problem, because proof of relationship would be her birth certificate, it can only be immediate family members or spouse

 

your wife will need to find another joint sponsor or your stepdad have income plus assets, because he will need to file the i864 and not combine income with your wife

That's exactly what I told my wife thanks for the clarification.

Also if he is currently (my step dad) making more money than last year would be a letter from his employer enough?

letter from employer and paystubs, plus he would have to put his current income on the i864, that might be enough
