hello everyone

My fiancee arrived through JFK NEW YORK 03/31/07 on k3 visa, but they did not stamp her passport with EAD, is this an issue to follow up on ?

Hello, If she did not get it stamped at that present time, then you will have to apply for it separately(nothing to follow up on unfortunately) ...could take up to 90 days to get......or just file the AOS and once that is approved, she will be able to work. I thought a K1 visa was for fiancee and K3 visa was for the spouse. My fiancee arrived on 01/29/07...we are married now, but have applied for both EAD/AOS and have recieved an RFE (returned info) and had a biometrics appt.....now we are playing the "waiting game" :) I wish the both of you eternal bliss, have a blessed day :)

my apology for mis-information she is my spouse, we got married in nov 2005

K-3s are not employment authorized (fiances are) and so she was not supposed to get a stamp at the POE.

She can now apply for an EAD, which should be valid for the same length of time as her K-3 admittance (2 years from entry, normally).

She can then file for AOS. There is an advantage for a K-3 to apply separately.
