Yeah, my lawyer knew that we were desperate to get my husband home as fast as possible so she suggested the K3. We paid $1000 to file it and come to find out that the K3 is absolutely free to file as long as you have pending I-130. So it appears we both were majorly over charged.

You are correct, if the I-130 is approved first or at the same time then the K3 will be administratively closed. This is because the whole point of doing the K3 is to be able to travel to the U.S. while you wait for your I-130 approval. So in the case that the I-130 is approved first or at the same time, then there is no longer a need for the K3 so they just terminate the application. And as you can see right now (if you look at other VJ timelines) no one is getting their K3 approved so it was a big waste of money filing the K3.

Yes I see the K3 was big waste of time to file. Now I'm going to my lawyer to demand a refund on what I believe he owes me back as all he did was type up the 1-130 & the 1-129f (K3). The reason I paid him so much is it was a flat fee for him to represent me and my husband from start to finish but the lawyer told me that my husband would come here and do all immigration things here which he would guide us on if needed.

In reality my husband has to do everything there in his country (medical, police report just like everyone else, so I feel betrayed and taken advantage of....

Well I paid lawyer 4500.00 for his services and yeah I'm pissed it slowed me down as I told him to file fastest way. Now I see he screwed me instead and didn't even feel good.,, Had to make a lil joke..

So I take it your lawyer filed the 1-130 and the 1-129f for u also?? Doesn't the 1-129f get tossed out if the 1-130 gets approved first tho? I don't know how it works..

Are you saying that filing the I-129f slows down the process for the I-130?

Did u file 1-129f for fiancée or 1-129f for already married?

I filed the I-130 then the I-129f already married (I didn't know it's obsolete nowadays). My PD for I-130 is Nov 25th and we're still waiting for approval. I've submitted an inquiry because it's past their processing times. And I've contacted my congressman. Aaaaand still waiting.

What Service Center are you here in? Nebraska? There's a web site called lawandborder.com

Check out that website as it explains everything in great detail.

If u can't access then let me know as I can copy and paste what it says but it's very lengthy

I didn't find that site on visajourney but I posted it here on visajourney not knowing that I wasn't suppose to. I was told by a person here on visajourney that I wasn't suppose to post the entire informational ad but I did by mistake...

Yes, but there is a LOT of information lol. So I will browse around and see if I can find the specific topic.

Oh good you found it. It explains what happens when some of us filed or the lawyers filed the 1-129f already married petition.

Why is there such a big difference in the processing time stated on the USCIS website (Nov 26) and the VJ processing times (Dec 16)? When I called USCIS a while back they said that they update the processing times after the 15th of the month. Seems like Nebraska hasn't moved even a day in the last month. We've been waiting already 8 months for our i-130 approval.

i-130 sent in December before fee change- around 12.22.16

1.3.17: Processing date for i-130.

9.27.17: Rec'd e-mail that i-130 approved!

10.5.17: Case sent to dept. of state for processing.

10.11.17: NVC rec'd case.

10.20.17: Rec'd case number and invoice ID number from NVC over the phone.

10.21.17: Filled out choice of address and agent.

10.24.17: AOS bill opened and paid

10.31: IV bill opened and paid (called 10.26 to ask them to process AOS bill and DS-261)

11.1: Bank processed IV Bill

11.3 DS-260 form filled out online

11.8 NVC package sent!

11.13: NVC package arrives at NVC

11.14: Scan date!

11.16: Sent expedite request to NVC

11.22: Expedite approved by consulate

11.28: Rec'd e-mail from NVC that package was sent to consulate. CEAC tracker states: in transit. Case Complete at NVC
12.11 Rec'd e-mail from consulate that package arrived, together with Pkt 3 instructions.
1.10 Interview apt letter rec'd via e-mail! (scheduled medical appointment)
1.25 Interview in the morning. Was told approved on the spot and visa should arrive in the mail within ten days! Yay!
1.26 CEAC tracker says Visa Issued!
1.30 Visa arrived!
