Yes I believe it is even tho I hear they can do very little if anything at all. Others on here got their congressmen involved and their response back from uscis is wait, so really is that of much help? Not in my book..

Have you tried contacting your congress person or Senator? While some have been unsuccessful in getting their elected leaders to help move their cases forward, there have been some who have gotten positive results.

 

Does USCIS even have your case? Did you get notification that your package was received? If so, then request an expedite, if you have not done so already. You have to do something inorder to get some movement.

Yes I requested a inquiry first of why I’m out of the processing time frame and I did request a expedite for a legit reason and still am told by uscis that they are reviewing my case.. ( But when ) as it’s almost been a yr. Maybe they are scraping the dust off the file which who knows at this point.

Ive called and told the same blah, blah, blah and more blah. I spoke to a tier 2 and honestly that guy was asking hey why didn’t you file this form and that form when you filed your 1-130 and I was like sir if you see my case you would see my husband is not in the USA and this is why I’m calling to get a status on my case so I can get my husband here with me.

Every phone call I’ve made has done not a thing except raise my anxiety level and raise my blood pressure. 

I leave it in God’s  hands and am so exhausted on trying to understand why Nebraska is the slowest service center and why boyfriend/girlfriend petitions are approved at a rate of under 6 months and they don’t even know if they want to be married to one another..

I pray for a good week this week after these Uscis workers got 3 days off..

 

Pray to see approvals and mine being 1 of them 😀

I just emailed my congressman , so let’s see if I get a reply as no one else replied.

Also, it is precisely of the "cherry-picking" that you referred to that makes this process a little longer. Given the environment that we are living in, the US must completely screen everyone who wishes to enter the country.

 

 

Excuse me?? I see your i130 was approved in a whopping 217 days. If only the rest of us were so damn lucky!!! Maybe if you had to endure what the rest of us are going through with waiting over 9-10 months (others up to a YEAR) you would have a little more compassion. Some of our cases are different than yours in that we have been married for more than a year and have kids. My son's 5th birthday is tomorrow and he gets to experience it without his father. But hey I guess it's easy to play arm chair critic when you only had to wait 217 days for your i130 approval!!!

 

Follow the thread. There are cases almost a month ahead of his getting approved. How is that fair? As for you saying get a politician involved. What do you think we all have been doing?

 

Do you know Potomac is taking 5 months while Nebraska is taking 10 months? Your logic about the "environment" makes absolutely no sense. Obviously USCIS is not screening or processing people the same when it takes TWICE AS LONG in one center compared to another.

 

A tier 2 supervisor agreed my case should be expedited and sent off a request. Nebraska ignores everybody. That place is a nightmare. I suggest you read through dozens of posts in this thread to get a sense of what is really going on because you don't have a clue.

My case went through Nebraska as well and I thought that 217 days was much too long. I did eventually request that my case be expedited after 6 1/2 months of waiting and within a few weeks it was approved at the USCIS stage.

 

I started the petition almost a year ago and my case was completed at NVC about 2 weeks ago. We are now waiting to be assigned an interview date.

 

When I deal with USCIS and NVC, I try to be proactive (call instead of waiting for email and/or letter), persistent (call a few times during week and make sure info given is consistent) and polite when I contact them.

It was also becoming an added financial burden for me with having to constantly send money to pay a company inorder to deliver water and food to the house.

 

USCIS does not care about the beneficiary's situation but it was important that I mentioned that I, as the petitioner and a US citizen, was being impacted negatively.

 

I really don't know if the case was eventually approved because of that expedite request or if the case was about to be approved anyway. I did request another expedite at the NVC stage but I was informed that the cases at the embassy are handled in the order they are received. NVC did eventually complete our case on 10/17 and as mentioned earlier, we are waiting for an interview. Unless an interview slot opens up for December at the embassy in Haiti, It's looking like it could be in January 2018.

All I can say is you’re D... lucky to be at the stage you’re at now. As I said I requested expedite as well but am ignored and it’s beyond frustrating. My entire finances are in shambles due to just fulfilling my families needs such as food, water and lights so does Uscis care??? No

There is definitely some sort of confusion with your case.

 

You filed for both I-130 and I-129F. Did you advise USCIS that you filed for the I-130 first and then filed for I-129F inorder to have your spouse enter as a non-immigrant to await the availability of an immigrant visa and to file for adjustment of status? 

 

When you filed for the I-129F, did you include a copy of the I-797, Notice of Action, indicating that USCIS has received your Form I-130? There would not have been a fee when filing the I-129F since it would have been for non-citizen spouse (K3).

 

I though the K3 visa was outdated but the I-129F application which expires on 8/31/2018 clearly mentions that a petition for that can be done.

 

Basically, you would have had to send the I-130 along with the appropriate fee and documents and then wait for the NOA. Then you send the I-129F with a copy of the I-130 NOA. No fee would have been needed since it is for non-citizen spouse.

 

Your spouse really should be in the US waiting for his visa since the I-130 has not yet reached the Department of State and if the I-129F was approved.

 

I have a feeling that if you had just sent in the I-130, you would have been approved already. I hope that you did not pay the I-129F fees as that would not have been necessary.

I hired a lawyer and he submitted in the 1-130 Pd of Nov 30, 2016 & then my Lawyer submitted in the 1-129f (already married) K3 and no he didn’t charge me for the 1-129f. My 1-129 f has a Pd of Dec 16,  2016 and still both are in the processing time frame so either way I should have heard something by now. 

If you noticed it’s rare now if any service center approves a 1-129 K3 and had I had a top notch Lawyer he would have known that...

My Lawyer said oh I will bring your husband and he can be here with u while waiting for 1-130 approval which is a lie and to be honest he is the one who more then likely delayed me, but then again I know others who filed just 1-130 and they are still in limbo do there’s no way to tell what is what.

All I know is it’s a mess and I pray to God to see light at the end of this horrible tunnel..

That probably would have been true about 10 years ago. Many people were able to have their spouses enter while waiting for the visa.

 

Is there a way to find out about both cases? Maybe the I-129F needs to be withdrawn so that your I-130 can continue to process. The I-129F is really for a fiancé visa.

 

Do you still have that lawyer?

Yeah my Lawyer is useless tho. He’s not made 1 inquiry or 1 phone call. I have done all I can do except wait for Uscis to close out the 1-129 and when that will happen I don’t know. Uscis closes it out themselves then approves the 1-130. 

Eother way my Lawyer raked me for 5000 for nothing

Don't you think it's hypocritical to be going off on people for not being patient enough when you got an expedite? You obviously felt your situation warranted you to jump ahead of the line. You want us to "do as you say" but "not as you do"? How would you feel after waiting almost 10 months and everyone around you got approved?

 

Most of us have accepted waiting is part of the process. I was patient and waited my turn for the first 7 months. After that I wrote to the heads at USCIS, emailed the Ombudsman, contacted politicians. Others contacted the media and others. If ALL applicants had to wait 9 or 10 months then you wouldn't see the anger. All other service centers are taking up to 6 -7 months tops. Why should a person at Potomac get to wait 5 months while someone in Nebraska has to wait 10 months? 5 months difference is a lot. In the past USCIS transferred cases to balance the workload.

 

If you followed Nebraska you would know between Sept and Oct the service center processed FIVE DAYS worth of cases in one month. This isn't a conspiracy, this is according to their processing times page. Nebraska is a disaster and nothing is being done about it. Those of us who are stuck aren't whining for the sake of whining. Our cases deserve to be approved in a timely fashion.

 

Waiting 280 days.
