Dear Visa Journey family, I am so so so  happy to share with you that finally after 265 days waiting, our case was approved!!!. My husband just received an e-mail saying that our case was sent to the Department of State :jest::jest:.

 

NOA1: January 27

 

God bless you all. I am pretty sure that your approvals are coming soon.

I noticed you updated your timeline, however your NOA2 is not known yet since you haven't received the letter from mail. That is where you will find the actual Notice of Action date which is your NOA2 (same way you are suppose to get your NOA1). Kindly use the proper date to update your timeline when you receive the notice letter. Thanks and welcome to NVC :)

Can't speak for the October filers, but pretty sure a bunch of Nov and Dec ones are being skipped in favor of January filers. That's based on chatter here. I'm an early December filer and still no news. That would skew the average.

on October 18, 2016 my I-130 get denied.

 

I don't know why and I will not know until I get the letter in the mail.

 

I just have to move forward and do what need to be done.

 

PLEASE don't ask if I cant think of what is miss or what I think cause me to get that because I don't know and I am not going to sit here and wonder what I forget to send or whatever.

 

The only thing I can do is sit and wait for my husband to get the letter and we will know what to do from there.

 

yes I feel bad for my family and I.

 

This is not the end it's and this is not the beginning...this is just to be continue

Timeline

Senator Nelson, D-FL, responded to my letter and said he is looking into my questions. What I asked him to look into:

  • Why is Nebraska so far behind
  • Why is Nebraska not being held accountable
  • What is Nebraska doing to clear the backlog
  • Why H1-B VISAs have a premium processing option and spouses do not.
  • Why work and student visas have a defined processing timeline and spouses do not.
  • Why USCIS has systematically made the K-3 VISA obsolete, a VISA congress enacted to avoid the situation us Nebraska folks are in.
  • Propose legislation to give U.S. Citizens an expedited process, same has H1-Bs.

Hopefully he'll come back with some sort of answers. I doubt it, but you never know.

I'm speechless and when you get that letter you can then move forward to correct whatever the issues are..

But also USCIS does not just deny out of nowhere unless they did send you 1-2 REF’s or there is more that they just decided to deny the application. They will not just open the application and say its denied. Plus the application has been sitting there over a year. We dont know how they process the cases and what exactly they look at. He'll most likely just come up with generic answers ,  if any 

I doubt he can do anything about this situation or even raise an awareness about it . 

 

but reply back with answers when you get them :)

i am in FL to so wanna know how helpful he is haha  

also i am thinking about writing him for case inquiry too after couple months lol
