we have two petitions (by mother and father) for the same beneficiary, same PD as they both were filed at the same time.

 

My father died after the petition was approved, so I became the substitute petitioner for him. 

 

So, which petition should we pursue now? And why should we chose one over the other. 

If I'm understanding u correctly. .U r saying both ur parents filed a petition each for their married child... same child  ,same pd , but u will have 2 cases number. . U r now substitute petitioner on behalf of ur dad.. but ur mom is also a petitioner for same child. Is that the fact. ?

Not necessarily. .As long as the case is approved by uscis before the petitioner dies someone in the US mostly a relative can take up the case..( Alternative sponsor)

That is correct.

 

the reason we did that was for the provision of automatic revokation of the petition in case of petitioner’s death, that we will have a second petition in line. Because substitute petitioner appointment is not guaranteed.

 

Now, the concern is “which” petition should we continue on and why? We can still continue both, but that would be meaningless at this time because of duplication of all documents and paying double the fee.

You should be going with the petition, in which petitioner is still living ,means your mother petition.... It will help in documentation and paying fees only for1 petition.

It is not simple as you think , you need to prove loads of things and believe me its hard to get approved

I would say do Not go on substitute petition its hard to prove loads of things...go on much straightforward way...

 

But i will suggest at the same time dont let other petition go away..kepp it going..for example first comes COA form where u dont need to pay anything.  Take full month n fill the form. After you fill the forms you will have 1 year until NVC keeps that petition with them . If you dont respond till 1 year they send back to usics.

 

Meanwhile process another application normally so ur both petition is alive

 

My one of the relative's Principal beneficiary died n they couldn't get visa

Because Substitute will always b  rated less than original. . Therefore u should proceed with ur mom (original petitioner. .) U can always be the financial sponsor if ur mom doesn't qualify. . U should let ur sibling gather together civil documents one time ..ur case should b current next month.. When nvc begins ur process they move fast , it's important to have everything at hand so no time is wasted. No need to proceed both..

Pink_niru raised an excellent point that dont let the other petition die and keep it alive, just in case. I think we’ll go with that.

I'm of the opinion that nvc will not allow both..y don't u email them they will better be able to guide u..or give them a call ur preference ..now is the right time to get on track so u will know which direction u r taking. Good luck..
