Hello amdavad2018,

This is the same case with my nephew's daughter. She was 10 years old when my sister filed the petition..now she is 22 years old. PD June 30  2006

We received the Welcome Letter to process step 1 to 6

I called the NVC and the asked me to an email  informing them to keep this aged out child on the Case and they will send it to CSPA for review, so I did.

DS261  Done

Paid AOS fees  Done

Paid Visa Fees  Done , When I got to this step the aged out child was not included, therefore I did not pay for her as yet. They told to call them back every two weeks or so to check on the status of the CSPA  review. I don't know what will happen after this, just waiting.

Thank You for your reply. CSPA is  very confusing and complex. But do you think so that only informing to NVC by email will work ? Does'nt it require to file some form along with the supporting documents. They didn't explain you about the EXACT steps to follow ?

  • The child must “seek to acquire” permanent residence within one year of a visa becoming available. USCIS interprets “seek to acquire” as having a Form I-824, Application for Action on an Approved Application or Petition, filed on the child’s behalf or the filing of a Form I-485, Application to Register Permanent Residence or Adjust Status, or Form DS-230, Application for Immigrant Visa and Alien Registration from the Department of State. The date of visa availability means the first day of the first month a visa in the appropriate category was listed as available in the Department of State’s visa bulletin or the date the visa petition was approved (if a visa was already available in that category).

Hi Redsquash,

Greetings ...

Thanks for the valuable advice.

Sir, by fulfilling this procedure, will his name be included in the Affidavit Support step, Visa Application form filling step also in the Visa Interview Letter along with the parents ? We wish to migrate all three of us together.

May2006, good to know.....She will be 22 years old in June of this year. I have been sending them everything they ask for.
PD = 06/30/2006
Approval Date  = 07/06/2009

I am hoping that their PD will become current by June 2018, then they may minus 3 years from her age leaving her CSPA age at 19 years old.
