I can't answer all of them, but getting birth certificate he can do trough skatteetaten.no. Everything is basically online in Norway so the same goes for the police records. You just do it online and in less than a week it should arrive at his house. I've gotten the a police record before because of a job i applied for and its easy. Not sure if it will be in english, so this he has to translate if ever. The birth certificate you can get in english.

Another question... I am kinda confused about the income requirements. Do I have to make 100% of HHS poverty guidelines or 125% for the k1. Also, which affidavit do I need to fill out?

Generally, only 100% is needed for the K-1 visa. However, some embassies still require 125%, I'm not sure if the one in Sweden does. 

 

The requirement for AOS that you will file for in just a few months is 125%, so if you can't make it to 125 now, how will you be able to get a greencard in a near future? The embassy might take this into consideration when deciding if they will issue a visa or not.

 

The affidavit you use for the K-1 is i-134.

The affidavit you use for AOS is i-864.

Sorry , this is wrong ! From the date of the approved interview you have 6 months to enter the U.S ( validity of visa ) It has nothing to do with the date of your medical . If you file AOS after a year from the date of your medical   , you might have to redo the meducal

No, you're wrong. In Sweden the Visa expiration date is based on the date of the medical. Maybe in your country you do it differently.

So if my fiance gets his medical at the end of this month, he has 6 months from then to come to the US?

One of my children I am not wholly financially responsible for. Her dad and I split time (I have her 7 days, he has her 7 days) will they take that into consideration also?

Visa validity is based on the medical, because the medical is only good for 6 months, therefore if you got your medical done 5.5 months before getting your visa issued, you only have that half a month until your medical (and subsequently your visa) expires for you to travel to the US, since you can’t travel to the US once your medical expires

No, they consider her your household member still even if she is only with you half the time, so your household size will still be 3 (yourself, your daughter, and your fiancé)

  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

Yes, really. The visa is only valid for as long as the medical is valid. The medical has a 6 month expiry date, they won't issue a visa that has a longer expiry date than the medical. The medical and the visa expires on the same day. That's why we recommend Scandinavians to not have their medical too far in advance, as the validity of the visa gets shorter.

No, they consider her your household member still even if she is only with you half the time, so your household size will still be 3 (yourself, your daughter, and your fiancé)

Sorry for all the questions guys, just trying to get all of this figured out... I started the job I am at almost a year ago (one year in July to be exact) and I know my income is enough currently but on my tax returns it will not show that. Will they look at my paycheck stubs and letter from my employer, or just the past tax returns?

 

Also, once my fiance is here and we get married, how long do we have to turn I'm his AOS?

Hey! Finnish here:) I have a question. We got our NVC number and now our case is sent to the embassy. (K-1 visa) Can I already book the medical exam or should I wait until we hear from the embassy that our case has arrived to Helsinki Finland? Is there anything else I can do while waiting? Like fill the ds-160? Thank you!!😊

There are never too many questions - that's what these forums are for :)

 

If I'm incorrect on the following, someone please clarify:

 

- I believe previous tax returns will still be requested and looked at. However, they should take into consideration your current employment, which is where your current paycheck stubs and letter from employer will come in handy.

 

- I'm not aware of a specific timeframe to file AOS upon arriving in the US and getting married (I'm assuming this is with the K1 visa?), but the rule of thumb is to take care of all of the above before the original expiration date of the K1 visa issued. If there's still some time between now and when your fiancé arrives so y'all can get married, I suggest to go ahead and start collecting items you plan on using or may need for AOS application, even the eventual AOS interview. Just for the sake of making it easier on you down the road. :)

Our paperwork has arrived in Sweden, now we are gathering the final paperwork. He has received his police records and military records, but they are all in Norsk. How does he go about getting it translated, can anyone do it? Suggestions? Thanks!
