January 2017 I-129F Filers

Hi all me and my wife get married in January 2017.

Filed For I 130 in February 2017

Filed for K3 Visa (By filing I 129F) in March 2017 (To just take chance as I 130 is delaying).

 

yesterday I got update through an email as below:

 

Can any one please explain that what it could be, I have no idea what to do?

 

 

I tried to call and spoke to level 2 officer buy they said I have to wait till I get a letter.

On April 6, 2017, we mailed you a notice for Receipt Number SRC1790XXXXX, terminating your status. The notice explains the reasons for our action. Please follow the instructions in the notice. If you do not receive your notice by May 6, 2017, please go to www.uscis.gov/e-request to request a copy of the notice.

I am asking here as this group is very very active and deals with K visa

Did any one in your group has seen this type of message ever on case status ??

Is it because I 130 got approves and they are discontinuing  ??

or it appears because of RFE ?

or it appears because of some other reason ?

I am not sure, but I was under the impression from this group that the K-3 visas were obsolete, and that you do a CR-1 when married (which I just looked up and that one you submit the I-130 that you mentioned).  Possibly they are returning it because they won't process it??  Someone who has been here longer might have seen this before though.

Are these filers really serious. Almost half of the petitions were return for incorrect fee. Why can people just go to the USCIS website to get the fee before filing:angry:

In practice, the K-3 is not a popular visa option. In 2014, there were only 392 K-3 visas, compared with 29,913 CR-1 visas. Some have suggested that’s because CR-1 visa processing times are improving. But at least equally important is that USCIS and NVC have conspired to choke off K-3 issuance. First, USICS routinely delays adjudicating the K-3 petition (filed on Form I-129F) so that it is adjudicated simultaneously with the related I-130. Next, the NVC will “administratively close” a K-3 visa application if it receives from USCIS the approved I-130 before NVC finishes processing the K-3 case: this is routine since USCIS sends both to NVC at the same time. Together, these practices defeat the congressional intent embodied in the statute that K-3 visas should be issued to allow the foreign spouse to enter the U.S. to “await the approval of [the I-130] and the availability … of an immigrant visa.”

I assume that most prepared for the petition earlier and didn't realise the raised fee after Dec 23rd ... just a guess

Tell me about it.. Slowly January filers are getting their NOA2. I am genuinely happy for them. The more cases get approved the less pending cases there are. Which means there's more chance they work on our case. But I can't help but feel anxious when I see January filers get their NOA 2 when their received date is later than my fiancee and I's. We are on our 93rd date since our case was received.

Same here. Early January filer, and it's making me nervous when I see later January filers getting approval first (I'm happy for them, don't get me wrong), because it makes me think I'm about to receive an RFE. My guess is that the ones getting it early are from Vermont service center. There are some from California/Texas ones that may have gotten it expedited. However, my gut feeling says that there is a box of case files and they just pull randomly. With the number of cases that there are, I doubt they have boxes full of files that are neatly ordered and filed in the order of date received.

Most if not all petitions for i129f, since March 2015, are routed to the California service center. Maybe a couple go to some other service center, but it's highly unlikely.

My fiancee and I are also worried we'll get an RFE. But I've been checking timelines here regularly and RFEs aren't necessarily a bad thing. Most of those who got RFE get their NOA2 2 weeks after their file is received. If anything it means a case officer is already working on your case.

Well normally when they terminate a case, it is because the person is not eligible...You will need to wait for the letter to actually figure out what it is and try to see why. It could be because your I130 got approved or something like this...

Is it an update for the i129f receipt? Seems like they're closing it down and going for the i130, k3 are obsolete so it was bound to happen anyway
