Timeline

Hey guys. Do you think being in Iran (one of those 6 banned countries), could be an issue in this step? Do you think USCIS could reject our case? We're kinda losing hope 😔.

Sadly, if the Travel Ban comes back into effect, yes. The concerned section of the ban specifically halts the issuance of new visas to Iranians not already in the USA. It is however worth noting that this part of the ban is not currently in effect due its constitutionality being federally challenged. If this were also to be the case at the time your petition is adjudicated, then in theory you would have every right to be approved, but as we all know at this point, the enforcement of this heinous ban has been catastrophic and confused throughout. My advice would be to keep a very close eye on things and also consider a legal expert to advise you during your case.

 

It is worth noting that USCIS said the following about the initial travel ban:

 

Quote

USCIS also continues to adjudicate applications and petitions for individuals outside the U.S. whose approval does not directly confer travel authorization.

This implies you may still receive K1 approval, but under the ban would not be able to be issued a visa/travel authorization. More here: https://www.uscis.gov/news/alerts/uscis-implementation-jan-27-executive-order

Thank you for your quick response. I know the issuance of visas would be affected, but the approval of the  I-129F form does not mean my visa is ready. Could they reject our form if the ban is back?

Yes, I have just edited my post to address that. It seems that USCIS will still approve petitions that do not directly grant travel authorization, as is the case with the I-129F.

I wanted to thank you for taking the time to share with us our K-1 status.

 

Do you have any idea why there were 31 cases approved for March filers only.  I know there are 5 expedited cases that were approved but how did the other 26 filers get into the mix?

 

Maybe there is no reason other than USCIS pulled other cases in the box as a matter of keeping their stats in line with their quota?

Hello I am a March petitioner. I was wondering where do I get the link or site to check the numbers I see posted above with case numbers? I am so confused. I know I have some time before I get a response back on my case. I was wondering also, it says here that I should get a answer at least by June, does that mean the decision or to let me know there were no mistakes in my package.

The timeline shows you the days you'll maybe receive the NOA2, the approval for the petition. Or at least a RFE for it, telling you that you have to send more informations. 

Most ppl have a time frame of around 90 days (some more, some less) from NOA1 to NOA2. 

You can check your own case on the USCIS site with the "my case" tool or use a tracker app from Google store.

Pretty sure someone will pick up the scans we do for Nov-Feb ppl atm in the future for March as well.

Thank you for sharing and CONGRATULATIONS on both counts, the approval and the baby!! You are the first of the group to get approved so it's a big step for us all in general!

 

First and foremost, you'll need to start planning what you need for the embassy. Police certificates, medical records, affidavit of support, etc. The embassy for your country may have this list online.

 

As for your case, it will get transferred to the NVC before getting shipped to your embassy. After a week or two from now, I think people start calling them to try and get their case number. Having this let's you track your case and also schedule your medical and file the DS-160!

That's great news, what time did u check ?  I'm still playing the waiting game , ughhh so aggravating lol, I'm wondering what time of day they make the updates

Checked 2 hours ago. So around 12:30 EDT. I haven't really checked in weeks. Assumed I would get an electronic notification. Don't play that game though. It will upset you ;-)

 

Most likely USCIS has a batch script that runs at 1 am to do the database updates. Just general IT practices.
