First of all you have to call USCIS (877-247-4647) press 9 and 7 to talk to agent then ask them for expedite request (they gonna list all criteria and you gonna pick one) then you will received inquiriy number.

Gathering all support documents that you request for and wait for their email ask for evidence (usually within 5 days they will send you email with Attention Code and Fax Number, write Attention Code on cover letter with Bold)

Same as you send out I-129F package, cover letter is the first page that guide USCIS Officer know exactly what they receive in order and they will easy to make decision. Following documents have to be in order and make sure you write down thank you letter as well.

The email for expedite request evidence is not RFE so your case status still stay as RECEIVED...after 1 week, call USCIS and ask them if they receive your fax yet and request for expedite response, if approve your case will be ahead and usually after 3 to 4 weeks you will have NOA2 or RFE.

P/S: if you do not receive email for request evidence or want to know they have your fax yet or not, call USCIS and ask to talk to TIER 2 personnel.

Hi all sorry to bother you. I got a question on something that is bothering me.

 

I was arrested twice around 13-14 years ago. For minor offences, so not crimes of moral turpitude. Of course I will declare them as and when I have the interview. I actually already have a B1/2 visa and discussed my previous arrests with the Consular Officer at that time and she granted me the full 10 year B1/2 visa.

 

I was just looking for a bit of advice, if anyone can help.

 

I understand there is no blanket answer at all and it all depends on the day, but I am guessing this should not be an issue for denial at interview? especially as I have already been approved for a B1-2 visa before. I know that the K1 visa is different and permanent, but I have been to the states several times since on my B1/2 visa and therefore can show that there are no issues.

 

does anyone have any thoughts on this?

 

do you think it would be ok?

what is the process for this at the interview? do they have to let my fiancé know first before they can approve it? (she knows everything of course anyway)

 

or can they still approve it there and then

 

as I said I am worried because it was stuff I done when I was between 19-20, none of which falls into the category of moral turpitude.

 

any insight would be brilliant!

Djhead, I'm going to try to give a non-political answer to a highly political topic, and sadly it is not going to be very comforting. 

 

In the political situation the US is in, there have been subtle changes to how things work on entering the US. 

 

The example I'm going to use is from an NPR (National Public Radio) article I heard about last night. It's about a gentleman who's been to the United States multiple times, either by flight or by driving from Canada. This gentleman is about 67 years old, and when he was 20 had committed a crime. 

 

This gentleman, was asked for the first time out of all those times that he has entered the United States, if he had a criminal record. He said yes, and was denied entry into the United States for the first time ever.  It did not matter but he's been in the United States multiple times. 

 

According to the article, they said it was at the discretion of the immigration officer. But there had been an uptick of Canadians who have not been able to enter the US because of the criminal record, since the start of the new presidency.

 

I am sure they already knew, based on computer records that he had this criminal record, so hiding it would have been worse. What precipitated them to ask that question this time I do not know. Maybe he had some sort of bad attitude in line. It could've been many different things the triggered this to happen. It was a mystery even to them.

 

Just because the consular officer grant you a visa, it does not mean the immigration officer will accept you into the country. It has become somewhat of a mystery at the current time. All you can do is try. And be honest. And if everything goes well you'll be granted access to the US to be with your loved one. Thousand and thousands of people get to enter the US. I wish you the best of luck.

I really cannot answer ... who knows if they grabbed the wrong box instead one of Dec filers? So yeah congratulations to all the lucky Jan filers in the box they worked on ... sorry for all December filers still waiting to hear something (like me :p)

Hi thank you for the detailed reply however that is a totally different situation to mine . 

 

I have visited the states numerous times on my current b1 visa.  The reason I got this was because I had previously been arrested and therefore obtained this from the US embassy as I was honest with them. I told them about my past at the embassy and it was approved.  

 

The situation with the Canadian gentleman is different as my previous visa was solely for the purpose of me being arrested 13 years ago.

 

So I would actually be going back to the same us embassy when I have my k1 visa interview.

Who knows the mysterious inner workings of the USCIS. I can imagine it being a pretty chaotic place to work, so maybe you're right and the wrong box was grabbed. It would be nice for some kind of ordered system to be in place, but I totally understand that one difficult case can throw that off, so they just have to do their best. I know it must be so frustrating for the December (and November!) filers to see them skip ahead, but I guess all progress is good progress. Or something. ;)

I thought the same thing myself. Totally appreciate that there's always expedites, but it's starting to seem like there's no way there are THAT many approved expedites...can we get excited yet????

Solid plan ;) Looking at the breakdown, the fact that they've only plucked cases from two specific days could suggest that two January boxes were picked up in error. However, processing has to start somewhere, right? We know it's common for them to jump ahead, as it's the only way you avoid a bigger backlog..so those lucky people in mid January are a sign that the wheels are beginning to turn! It will be interesting to see what happens today and tomorrow, as that will be truly indicative of where we are!
