Timeline

Good evening ladies and gents,

I successfully obtained a K1 visa, travelled to the United States and am now married within the 90 days specified. The process of AOS now begins and i am unclear on certain things. When i first applied for my K1 visa i was contracting for an American company in the UK. They agreed to write a letter stating i would earn X amount and that my job offer letter was confirmation. My visa was approved on this basis, the basis that i would have a job waiting for me in the US. The AOS form is now stating that i need a co-sponsor. My wife currently isnt working and we are living on the savings i had before i came over until all of this was cleared. It seems as if i can't get my company to sponsor me for the AOS, is this correct? Even though US immigration let me into the country on a K1 visa based on a job offer letter from my company i now need a co-sponsor? What if my wife cannot sponsor me, does anyone know of any other alternatives to get this resolved properly?

9-01-2006 - NOA2 (5 MONTHS LATER.... LITERALLY 5 MONTHS LATER)

9-14-2006 - NVC received case

9-30-2006 - Packet 3 received

10-4-2006 - Packet 3 sent out

10-17-2006 - Medical appointment

11-3-2006 - Packet 4 received

12-1-2006 - INTERVIEW - approved

12-14-2006 - Amie moves back home

1-1-2007 - Martin moves over

1-16-2007 - SSN received

3-18-2007 - MARRIED!

Martin,

You entered as a non-immigrant. Non-immigrants do not need a sponsor if the can support themselves, which you can.

Now that you want to adjust status - become an immigrant - different rules apply. Your petitioner must sponsor you, and that's your wife. Your wife can use the total household income to do this - her income plus the income of other people living in the household. You, for one.

Read the I-864 instructions. They explain this pretty well.
