We made a stupid mistake with our I-864 (Not sending in the tax related stuff. Don't ASK how that happened!) and have been asked to re-submit it. I'm really worried and confused now. What exactly are we supposed to submit as evidence along with this form?

We have a copy of the 2006 tax return (1040a) that my husband has from when he filed his taxes online, but it has 'copy only, do not file' printed on it. I think it is the copy of the tax return sent to him by the IRs for his records. Is this OK to send, or do we need to apply for some certified tax return from the tax people?

Does any part of the form itself need to be certified? I keep getting conflicting advice on various websites.

Do we need to submit tax returns for the past three years, or just from the most recent year as it says on the form?

I know this must sound really pathetic, but I'm terrified of getting it wrong again.

People make mistakes , you're human........don't be so hard on yourself.

If they asked for you to completely resubmit the I-864 then resubmit it.

If they asked for just your tax info then the copy you have of the 2006 taxes is sufficient. Be sure and include everything that was filed with the taxes( w-2s, schedules etc)

Nothing needs to be notorized.

You have 2 options: 1~ list income for the past 3 years and send the most recent taxes

or

2~ list income for the past 3 years and send all 3 years

I sent what I had printed off H&R Block when I efiled as well as my W-2 statement (copies) for 2006. Additionally I sent a letter from my employer stating when I started, what my position is, how much I make per year and if my employment is permanent (aka - not a temp); a letter from my bank stating when my accounts were opened, how much was deposited in 2006; and then I printed out my account balance as it stood the day I turned in the AOS stuff (from online).

I have not received an RFE for the official tax transcripts, but I was proactive and requested them anyway just in case they're needed. If your husband calls this number and goes through the prompts, they send them to you quite soon (I got mine in 3 days!): 1-800-829-1040.

You do not need to submit the past three years unless his income for 2006 is near the poverty line. Of course, you need to put the gross income for the past three years down on paper, and it might not be a bad idea to request the past 3 years of transcripts from the IRS if you request 2006.

It does not need to be notarized. The other affidavit of support (I-3somethingsomething) did.

And since they said to re-submit it, I'd send the whole package over. Don't send originals (only copies), but send as much as you can to prove your husband can support you.

06/04/2010 - Sent I-751

06/07/2010 - NOA1

06/09/2010 - Check cashed

07/22/2010 - Biometrics Appointment

09/08/2010 - Card production e-mail

The best thing to do is call the IRS 800 number and there you can choose for them to send you the transcripts of the last 5 years tax returns. They are the best as everyone here and myself have sent them for my wifes K-1 and now AOS without any problems. It takes them about 10 days to mail it to you once you place the order over the phone and its free. Good Luck

I agree that transcripts are best. Fast, free and preferred. 5 years is overkill IMO, but the past 3 years is a good foundation (I've not ever seen anyone asked for further back than that).
