They have to tell you if they send it back. Is your lawyer a visa lawyer specialist ?  I'm not sure if it makes a difference but I would hope he can advise you what to do this is most alarming, I'm older than my husband also but if it was a man petitioning for a woman they have no problem!

You will receive a letter known as ( CALL IN LETTER ) the applicant will then go to the embassy with that letter and get an appointment for reaffirmed cases. It takes time to get the letter maybe 2 - 3 months. Our case was reaffirmed in July 2016 we got the call in letter in October i went to the embassy on the 26 October and got an appointment 16 January 2017,  is very slow at the embassy i will advise everyone to be proactive on their cases keep calling and emailing them....

jefraylee I didn't know about this (CALL IN LETTER) thing, according to the NVC reaffirmation notice I received in January, my case was sent to Ghana on December 29, 2016. that means I should expect the Call In Letter by the end of this month? It's really slow then. But why are they saying they don't have the case in their system?

Because, as I said before, there is a queue for the reaffirmed cases and it takes several months to enter them

into the system. Once they are in the system they will see it on the screen, otherwise if it is not entered yet they will

see it as not being there. Ghana is so non transparent in their process and instead of informing you they ignore.
It is a mix of CO's gone rogue, not enough people hired to do the work and bad leadership/training/management.
You can count about 6 months at least from NVC mailing it until the second interview.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

It's the embassy that issues out the ( CALL IN LETTER ) so wait you will soon get that letter in your mail....

So this has not been returned to the Uscis at all? I think they do not do any type of research just read the screen of computer and tell you what's there . They possibly were reading the return  from original time.

jefraylee, so is the petitioner also gonna receive this (Call In Letter) or it's only the beneficiary? so that I can tell my wife to be checking the mail box. Thanks

Well the letter will be sent to the petitioner not the applicant, Because my letter has my wife address as ( Care Of ) This is why the process is slower , because the applicant is in Ghana why wont you just send the CALL IN LETTER to the applicant here in Ghana rather than sending it back to the USA? The competence of the embassy is questionable.....After my interview since January am still waiting the medicals is valid for 6 months and will soon expire so if the visa will be approve one has to go and pay for another medicals fees costing almost 450$

Lutz in our Uscis we got a notice that says the case was returned on march 1 2016  but that was two months after the NVC got it back the forwarded it on to Uscis but the date Uscis got it back I got email and status on Uscis same now 12 months buts NVC should know if they sent back.

Jenilyn and Awal , we are talking about those whose cases has been reaffirmed by the USCIS after it came back from the Embassy in Accra after first interview denial. some of us has already passed through all what you are talking about. We are at the reaffirmation stage ,waiting for the 2nd interview. So this thread is about CR-1 REAFFIRMED CASES IN GHANA
