We got married Jan 2016 

I filed i130 fed 2016

Found out i was pregnant in March 2016

My husband had interview Oct 2016

Our baby born Nov 2016 

I said all this to say that when I found the paperwork I did not know I was pregnant and could not say on the forms we have a child because she was not born yet can I give him a birth certificate to take to the Embassy because he went before she was born I did try to write the embassy to let them know that I am pregnant I need my husband with me but they did not care this was before his interview so now I don't know if I can send a birth certificate to USCIS while waiting for the Noir USCIS receive my case back April 2017 180 days should have been October but have not heard anything as of yet when I did inquiry they said they are still working on it with no timeline so here I am

I'm not sure if letting them know he has a child or sending the birth certificate in with the paperwork will do you much good, unless you have had a DNA test to verify the child is actually his. Whether you got it done there, or here. However if they send you a NOIR, i'm sure you can put it in your proof but not sure it would hold any weight since he hasn't signed the birth certificate. 

 

Also you do not need to wait for the NOIR to send the USCIS information. You just need to make sure your case number is on all the paperwork, they will file it away with your file and it should be there when they finally decide to look at your file to confirm everything. 

 

But i can tell you if i were you, while you are waiting, i would get that DNA test done. You would of course have to order the Kit from the company you will use, somehow get him to swap his mouth (if you go over and do it or risk sending to him in the mail and him getting it back to you) and get it all verified that he is the father. This can be something you are doing while you are waiting to strengthen your case. Because you may or may not get a NOIR from the USCIS, you may just get a letter of reaffirmation, basically meaning they don't need any additional information and they will send your case back to Ghana. If he has the DNA results when he goes for his next interview. It can only strengthen your case.

So sorry that's what they tell everyone, contact ombudsman and ur senator and explain everything to them they will ask for paper work make sure to add a copy of your daughter's bc. Good luck and stay strong for your hubby and daughter I know how u feel because I have been there,

Thank you so much dear thats a good idea ill do dna test while im waiting. I have a question is there a place in Ghana i can get dna testing done? When the embassy request people to get dna testing done do they only use certain company's like they do with medical?

Google DNA,  I did one in 2008 , I pick the place here and I asked them if they were accepted by immigration process and the lady said yes, so u can do the same thing once u find one.

Ok so the embassy dont require a specific company to do the dna test than?

I don't think so unless they change it,  but all the same Google, I could have given u the number, but I'm in Pennsylvania,but I don't know what state u are. my mouth was swap from here and the beneficial her was swap in Ghana, and they sent the result directly to nvc and just send me a copy.

Embassies require that only certain DNA labs on their list is used in the US for collection and only certain physicians for
specimen selection for the beneficiary.
The cost runs $600-$800 and takes about 8 weeks for completion when the results are mailed directly to the embassy.
If not requested then I would not do it but submit the BC with the NOID when or if you receive one.
Since they do not recognize test results from outside their approved labs they can not take the test result into consideration and in the long run a child
in their eyes does not prove a bona fide relationship unfortunately. They request DNA for immigration benefits mostly and not for
bona fide relationship evidence.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Ok thank you so if i get noir having dna test to submit with rest of evidences wont help in getting reaffirmed by uscis what your thoughts

Timeline

You can search for AABB accredited labs that USCIS accepts, however the specimen collection for your spouse needs to be done
by a panel physician not just anyone for the results to be recognized. It's just not necessary unless requested.
Focus instead on what points the NOID letter will say and gather good bona fide evidence to dispute the CO's findings.
The choice is yours of course.
