And will probably have a good amount of time from now before you will hear back from them. It's really sucky but at least you know, based on what all others here have gone thru. Looking like that waiting period is anywhere from 1 to 2 years (fluctuates depending on your case) from the time they received your case back.  Just stay strong, use this time to strengthen your case. I assumed once denied and sent back everyone got a NOIR - why is this not the case?  Do you know?  I'm just wondering.

No, it all depends on what the reason was that the Ghana Embassy says they denied it. If the USCIS reviews your case and finds the embassy had no reason to deny it in the beginning and they don't see anything else that you need to prove about your relationship, they will simply re-affirm the case and send it back to the Embassy in Ghana. Unfortunately since they don't trully give you a reason, you won't know if your case will require more info or if you will simply be re-affirmed.

well that's interesting.  you never know why they sent it back in the first place or even if there WAS a reason.   So in a case like this, do you take any and all proof u can get ur hands on to present at the time of your reaffirmed interview?

 

And the timeframe for just being reaffirmed w/out a NOIR is cut or just as long? 

 

I've always said this is just a money making scheme and they deny everyone from the get go.

Well whether your case is reaffirmed or if you get a NOIR it will be good to take any UPDATED proof you have that you had not turned in previously or after you got the NOIR with you to the interview just so you have even more proof you're still together. Such as copies of plane tickets/boarding passes for additional visits, updated photo's together etc. But anything you provided them previously isn't necessary, they will already have it in your case file. There will be some additional documents you will have to update such as the Affadavit of Support (you will not have to pay the fee again), the Police Report, yes you have to pay again for it, since it will have expired by the time you go back. And the medical, (but note there will have been some vaccines that were done previously, that he will not need again so make sure when you go back for medical that you tell them you have been there before and don't want to re-do the vaccines that will not have expired, this should lower your cost a little)

 

But yes it seems the time frame it takes to hear back from the USCIS where they send you a NOIR or reaffirmed letter, is about the same time frame. Although if you receive a NOIR rather than a reaffirmed, most likely your time AFTER that is going to be longer. From what i've seen in this forum, those who have been reaffirmed, usually gets an interview date sometime between 4-6 months after the reaffirmation. However if you get a NOIR, you'll need to include the time you send them your updated proof and the time it takes them to process everything and reaffirm after that. 

 

I can tell you though that the Ghana Embassy up until this year had some pretty shady people in there. There were people there that were denying people just because. This caused a severe backup of Administrative Processing Cases at the USCIS.  It is my understanding they revamped that whole department and they now have all new personnel there. And since then cases have been going much smoother with less denials. My husband had a friend there that worked in the administrative side. She was not an agent, but one of those who processes the paperwork in and out of the embassy and this is what she told him. I used to think it was a money making scheme too until i found that out. I think the entire issue with this process is the U.S giving the Immigrants country of Origin, all the power. To me that is a HUGE issue, especially when so many of these countries are extremely corrupt and because they do not truly do a real interview of the person. 3-5 questions WILL NOT prove to you that this relationship is real. I can understand if you are saying they haven't visited enough or  you haven't provided enough evidence of the relationship, but to disprove it because the immigrant couldn't tell you what their spouses parents do for a living is asinine.

well written.  We were originally denied becuz we did not have proof from March to October - although we had proof from July to October and stated such.  My thing is if we did have this March to July proof wouldn't THAT have caused more concern.  As who would be keeping proof because we did not know it was needed.  Also the corrupt agent stated we were in a smuggling ring and offered no proof of such accusations.  What we were supposedly smuggling, we had no idea.    This whole process from the beginning has been a nightmare for us and I believe the whole system needs overhauled.  I'm glad to hear there are new agents interviewing and am hoping future cases go smoother than ours did.

In the meantime you may want to figure out what proof you DO have for that timeframe they denied you for. You can always send it to them before they send you the NOIR. It will become a part of your case file and at least they will have it by the time they finally decide to look at it and you can try to avoid the extended time of the NOIR. It can be phone calls, text messages, etc. If you spoke on social media, things like facebook messenger, Whatsapp, Skype etc. They usually have in their settings a way for you to download your conversation history and email it to yourself. You could try that. Or if you spoke by phone, go online and check your old bills, or ask the carrier to send them to you and highlight those phone calls and the time spent on the phone. We had this same issue, we originally had our appointment in June 2015 but we were missing the proof from the very beginning of the relationship because we no longer had those accounts that we met on. But they told us we needed more and set up a new interview for July, well i found everything i could, my husband went there armed with 800 pages of conversations (this is when i first found i could download the conversations) and guess what. They didn't even look at them. He walked up to the window and they gave him the 221G with no explanation, just told him to contact the USCIS after 60 days. When he told me this i really wanted to punch someone in the throat, like we paid for all of that paper, AND the cost to ship it only for them not to look at it. Was crazy. But yeah good luck to you. I think you can relax a little right now since you probably have some time to go. Just use this time to create more proof of your relationship. I've yet to see anyone's reaffirmed case, on either this forum or any others i belong to, be denied so that's hope i guess :)

reaffirmed May 25, 2017 - we still await word for our appointment.   I just wrote the Embassy today but do not expect to hear from them as my senator just wrote them on the 5th of this month to check on their new system seeing as how they only respond every 30 days.

we have been reaffirmed May 25th this year, we r just awaiting interview

We started this process October 2013 - 4 years we've been married.

Some day soon I will need all the support I can get as eventually when my husband and I get approved and then get to the NVC for some more months of waiting then off to the Ghana Embassy I will need all your support and helpful guidance, as I know Ghana Embassy is tough to get through, so hope all will be avail for me down the road. 

I read lots of forums on here and I keep asking why is Ghana Embassy so hard on couples and all I can come up with it's due to high fraud country. God help us all that are legit happily married couples..
