Thanks for sharing! At least we don't fight : ) My husband is like many people here, he is calm. I don't think we were on top either, for example we didn't put him on electric bill until recently because we thought it's no big deal.

Thank you : ) even though it's driving me nuts that they would think that about us, i hope that's what's going on in fact, and when we send them all the affidavits, social media pages, text messages, and if they come to our apartment they will have no doubts left (the lawyer said they may come). Also hope nothing like this will happen when they get to i-485!
Im going crazy most likely because, like i mentioned here before, i know other people from my country who went thru the same process, same situation as ours, one spouse overstayed the same visa and another spouse is a usc, and no one had any problems! So i keep asking - why us then... i know every case is different but not that different really, everything that matters to uscis is pretty much the same in all these cases. Yes my husband was married before, but some of those people had a lot less financial proof than we do for example (i asked), others had a big age difference, and uscis didn't give a hard time to any of them.

There is nothing alarming abour this case...nothing "surprising". There are more couples on VJ with wayyyy more rrd flags that have less problems.

They are both close in age and she isnt from a high fraud country. I really do they lost their application, wrote the wrong A number on the file and the case has been a mess. 

I really think due to all thus, uscis is taking there sweet old time! Again, wait to get a noid...she may not even get one!!! They obviously have no clear cut rrason or they wpild have had the noid by now. It also needs to get signed off by the head officer.

They actually have no red flags...its obvious they live together. They didnt even file right away and again, they are close in age (and they are all over each other SM).  

The only thing u can do is wait and every few weeks do a service request to see what is going on. It will work out in your favor - u will be successful, but it may just take a bit longer. At least you are in america:/

I never said there was anything "alarming or surprising" about their case.  I am simply suggesting that someone suspects fraud...that does not mean I am saying there is any fraud.  I also don't believe for a minute that USCIS is taking "their sweet old time!"  Do you really think that these hard working officers are plotting against individuals?  They are simply doing their jobs.  Nor did I say there were any red flags.  If you are going to quote me quote what I posted...not some imaginary things you apparently think I said.

Something that the OP isn't telling us (which seems unlikely but who knows)
USCIS may know something the OP doesn't know


For the most part, anyone dealing with this kind of wait time has had SOMETHING to trigger it. It seems too odd that it's just happening like this for no reason. If the case was as clean as it sounds, it should have been an easy approval that USCIS could wash their hands off of and move to the next case. Not toy with it for years.

With that said though, until more info comes to light like the OP gets the NOID or hears something from USCIS all we can really do is speculate, which is really what this whole thread has been about anyways.

Bc uscis lost the case for months and thrn Assigned the wrong case number and mixed it up w someone else.... put the wrong Alien number lol I think that's really what it is.... and she may have gave a little attitude at the second interview after 1.5 yrs (prob not the best). So I think that has contributed.... plus, u can wait months to get a noid...again, they need proof maybe just taking sweet time...that does happen a lot...they don't need to worry about ur case, u r at the end when they have free time lol 

I really think it's mostly bad luck... once they mix something up your case kind of gets mixed up in the shuffle of things:/

I tell everything i can think of i promise : ) there is no point to start a topic, ask for opinions and hide something at the same time. Unless there is something i can't even imagine is related... like the fact that my husband doesn't eat onions Lol. Also, i just though of it - he already petitioned once and it was approved. Is it a positive sign? I mean, unless something horrible happened after this (which i believe we would have known) it means he can petition and can be approved.

If it relates to the items on the list, yes.  If it's random excess, no.

This is the best attitude.  It's not lackadaisical, but it's understanding that things are often beyond your control and being happy to be together, that shows to others.

Oh dear God we finally got the notice!

No, not in the mail - we had to go there again, asked for the supervisor, and he brought us the notice within 30-40 mins (which means they probably had it ready because it's 3,5 pages long - why they did not mail it to us for 2 months?! )

First two pages are list of documents we already submitted, and then go the reasons for possible denial. I'm planning to retype it all probably tomorrow because we are going to respond to each sentence and email our response to our lawyer, and i'll post it here too, but basically 2 main things:

 

1) we did not have a joint bank account until january 2015, and we got married in spring 2014. So they are asking about that (the whole notice is long plain text, they don't make points like 1, 2, 3... which makes it harder to read and address to the issues)

2) We moved in together in 2013, which is what we indicated in our application, but my husband was not on the lease until a few months later, when it was time to renew the lease (i moved in to this place by myself first) we put him on the lease too.

 

I mean, we cannot turn back time and put him on the lease now right? We were honest and told them when he actually moved in. On his i-325 or whatever this form is called, he indicated where he actually lived. I just can't!  What was he supposed to say? He lived here, nowhere else, just wasn't on the lease for a few months. Ridiculous, we could have said he moved in a few months later and we wouldn't have this problem!

 

And about bank account, first of all, my passport was expired and we could not put our accounts together without my passport (ID was not good enough, i was asked for passport), and second of all, well yah, we kind of were not in hurry, separate accounts were working just fine for us.

 

Other issues:

3) question about interactions with other bank accounts - my old one and husband's mom's account, they are asking what those are (we will explain the old one and my husband's mom's account - we send money to each other from time to time).

 

4) something about how we are not using our checking for bills and groceries - well yeah, because like i said we use our credit cards and then use our one and only checking account to pay them off. We will explain this too.

Why this was not asked during the 2nd interview? why they didn't ask what those two accounts are? why they didn't ask anything about how out checking account activity is basically just payments to other cards? If those were the issues, what was the purpose of the 2nd interview if none of it was asked?

 

5) they said that even though we provided bunch of photos from traveling we did not provide any from christmas, thanksgiving, halloween (thats true, we just don't have any! is it a crime not to take pictures? In fact we were both working most of those holidays back then, ugh!) and from birthdays (not true, we actually have pictures from each of my b-days starting 2011 and some of my husbands bdays - we just did not take photos each year, and he hates pictures too so yeah... thats how it is.)

 

Nothing about ex-wife, nothing about our answers during the 2nd interview. Who would have thought. I suspected though that it will be something like our last rfe, asking for information related to bank accounts/lease.

Wow... I've been waiting and wondering about this...  It seems like it's just a matter of many small things in their eyes adding up!. As you say, you have perfectly good explanations for all of that, which should also mean that you will pass this hurdle... Although with "a bit" added time.. I can say... we didn't take any pictures this Halloween or Christmas... geeee guess this goes to show how important all those small things can be...

You think those explanations are good enough? i hope so. What else can we do now except to say how it was lol

I'm also thinking we can get affidavits from friends/relatives who will say when exactly we moved in together. Our building janitor form 2013 moved to europe and besides he probably doesn't even remember us and especially doesn't remember the dates my husband moved in (it's a pretty big building), and the management company doesn't even know the exact date besides the one on the lease.

I tried to ask to schedule me for fingerprints but the supervisor said no  I was like, "there is no way i-130 will be denied lol (really! how can it be! deny because we didn't put bank accounts together the day i got my passport, well there is nothing can be done about that now!), how about i do fingerprints and medical too and we submit it all at the same time". But no.

that is CRAZY!!! i wasn't on the lease, we dont have a joint bank account.. we do file taxes together and have photos.. geeze! u got one crazy IO officer!!!! 

u will get the GC its just going to take more time:/ this is pretty ridiculous!
