Timeline

Hi All, we received an RFE letter 2 days ago. 😞 They wants us to submit additional evidence to show that we entered our marriage in good faith. Below is the letter received. I would like some recommendations or suggestions based our status. Sorry for the long post.

 

Items that they requested are below.

 

Item#1 - Children as result of your marriage.

- Unfortunately we are encountering difficulty from having children. We have been seeing fertility specialist since April this year, so we're planning to send available documents from the fertility clinic, such as emails between us and the clinic.

 

Item#2 - Evidence that you and your spouse have resided together and shared responsibility for common residence.

- We are currently living at my mother house right now and everything is under my mother's name. We can only produce copy of our driver licenses showing the same address, paycheck stubs, separate banks statements with same address.

- Phone bill is under my name only, but my wife phone number is listed.

- I have my work health coverage plan showing my wife as beneficiary. Same with my retirement plan.

 

Item#3 - Evidence that your and your spouse have combined financial resources or joint ownership of assets.

- We have joint CapitalOne saving account. We each have our own checking account that deposit money in our CapitalOne account. I guess we need to submit statements for all 3 accounts? Do you suggest every month for the last year 1/2?

- We also have IRS transcripts for 2016 and 2017 and W-2. 2015 was submitted previously.

- We have no utility bills. We have joint car insurance statements.

- Health insurance documents.

- No loan or joint credit card statement. 

 

Item#4 - Evidence that you and your spouse made estate, health and financial arrangements.

- We do not have anything here at the moment. Should we try to get power of attorney now? Is it too late now to get?

 

Item#5 - Affidavits from third parties.

- We're planning to get my mother and 2 of our friends to write a letter. Is it necessary to notarize each letter? I see ppl are doing it on VJ.

02/09/17 - NOA Received, conditional resident status extended 1 year.

03/09/17 - Biometric completed.

03/01/18 - I-551 stamped at local office.

04/05/18 - Receive notice that case transferred to local office.

08/03/18 - Received RFE notice in the mail.

09/10/18 - Mailed out RFE package.

09/13/18 - RFE packaged received at Nebraska office.

09/21/18 - Status changed to "New Card Is Being Produced".

09/24/18 - Status changed to "Case was Approved".

Thanks. We thought we sent everything at that time and didn't think we were going to get RFE. Now we wished we should have prepared for the worst outcome.

John,

 

I don't have the paperwork at the moment. I can check when I get home. But I thought RFE is the same as request for additional evidence. Did I misunderstood?

I was in the assumption that a request for additional evidence was a 2nd request. I had a RFE in March and am going up for my interview next week.

We got almost the same situation, so we sent what we had (almost nothing) and now we are waiting again. We sent signed letter from my in laws confirming our domicile in their house. Let’s see if they will ok with it

We are producing your card and will mail it to you

You do not need to do anything at this time

We will mail your Green Card, employment authorization document (EAD), or combo card (EAD and advance parole) to the address you gave us. It may take up to 120 days to deliver your new card.


I am assuming my case has been approved? I am just beyond happy.

I've seen people here saying hang in there, you will be approved soon but this was a really, really long journey. Filed on Jan 18, 2017. Almost 19 months.

Yes buddy, you're approved! That means that the evidence you sent sufficed and there's no need for interview. I filed same month and year as you...I guess you din't filed for N 400..did you?

What a relief!  status updated again:

We approved your case

Read the notice we mailed you for more information

If you do not receive your notice by September 08, 2018, send us a case inquiry and select that you did not receive your notice by mail.

 

They haven't update the old website only the new one, any news on your case? I did not file for N-400 yet even though I was tempted to do it back in January when I was eligible I decided to clear my I-751 first then move onto my N-400. I have an overseas trip coming up in a few months I will probably wait until I am back to file for N-400 or maybe soon due the the latest news on citizenship.

 

It does feel good to not have anything pending with them for a bit .

Hi All,

 

I got my green card in mail on July 21st one day after I received the letter of approval.

You can update my timeline record, Card received 7/21/2018.

 

Good luck to all of you, still waiting for their GC. I hope it comes soon and it will.

01/2017 Filer here and still waiting, filed N-400 too last 02/2018 and says that case completion should be 1/2019. Hoping to get Permanent GC approve soon before N-400 interview which I don’t know when. Most batch got their GC already, it’s been a long long ride.
