My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Per tracking, they received my waiver on April, 05th, this year. I did called USCIS customer service and Tier 2 told

to wait for their response by mail. And I was patiently waiting for their response. Well, yesterday I did receive approval notice and that I will receive my GC in 60 days. 

Now I’m confused..and stressed out. I was waiting for approval more than a year and now I’m worried if they received his death certificate and  are they aware what happened to me. I don’t want to have problems when I apply for citizenship next year (waiting for 5 year mark). 

Please advise and what is your opinion and if you need more details I’m willing to share...It’s sucks that even their customer service rep nor  Infopass officer were not helpful. Should I make another Infopass?

Hi there, sorry for your loss. I would suggest you schedule an infopass appointment as soon as possible and bring your husband's death certificate as a proof. They will be able to help you.

Thank you. I already had my Infopass and they’ve told me to send my waiver including with my husbands death certificate. Which I sent on 04/04-they received it following day. But I worried they approved my jointly filed request while they didn’t review his death certificate and my letter I sent.

What is the date of the ROC approval letter? Did they receive your husband's death certificate before they sent you the approval letter? In all of these scenarios, you would need to schedule an infopass appointment again to tell them that you are in this situation. This is what I would suggest but don't you worry because you did your part by informing them, thanks.

Yes, that’s the confusion I have. Since the date on my ROC approval letter I received yesterday  is actually 04/09.  And per USPS they received my waiver on 04/05. When I called customer service they didn’t know anything about the receipt of my notice. I guess I will have to make an Infopass just to be on the safe side. The weirdest thing is that we were waiting for approval  (I’m sure everyone here) for more than a year and now I feel confused. Thank  you so much for your response

Yeah, you are right and honestly speaking you will be absolutely fine because you are not hiding anything from them. You have sent it late which happens all the time people go through some tough times and you are not the only one. They will cooperate with you as long as you update them, regards.

So sorry for your loss. I'm curious why you sent the waiver and death certificate to the Nebraska Center? Shouldn't it have been to CSC/VSC, or did you have a transfer?

If you file and then move, it will not disqualify your application, but it may delay it. You have to inform them of your address change (file the form and call them to update). They may also still mess up and give you an interview/oath ceremony in the old state.

Hello, yes, my case was transferred to Nebraska, on 03/04. I received a letter explaining that they moved our request. At this point, I believe they are the ones responsible of my case.

It sounds like you did everything correctly, and they approved you without issues. I don't think you will have any problems with getting citizenship... and if you do, you have proof that you did everything right. I guess you can check with the officers at the Infopass appointment.

We just received my wife's approval letter for Removal of Conditions! Such a wonderful thing to see some progress finally being made. Now on to the citizenship process... :) 

 

FYI, This was our timeline:

Filed I-751 on January 6th, 2017

Held at CSC for quite a while...

Received notice of transfer March 15th, 2018 to the Local Texas Office

Status changed on USCIS website April 10th to "Name Updated"

Approval letter received in mail on April 14th, 2018.

Interesting so if your case is actually moving to TSC or nebraska then it’s a good chance your case will be looked at within a month.

January 8th 2014 - NOA1

July 10th 2014 - NOA2

NVC

July 17th 2014 - Case shipped to NVC

July 30th 2014 - Case received by NVC

August 13th 2014 - Case number and IIN received by email

August 13th 2014 - DS-261 Form Completed

August 14th 2014 - AOS Fees Invoiced and Paid

September 17th 2014 - IV Fees Invoiced and Paid

September 19th 2014 - DS260 Completed

October 6th 2014 - AOS and IV Packages Received

November 28th 2014 - AOS and IV Checklist (4 items in total. 3 for documents they lost. Called on December 9 and a rep said no checklist for IV....go figure)

December 8th 2014 - Checklist scan date.

December 30th 2014 - Case Compl........NOT. So after not having an interview date yet, I called again on Jan 30th and apparently its in final review with a supervisor.

February 6th 2015 - Case Complete: Supervisor called from NVC to confirm everything has been completed now.

March 27 2015 - Interview Date

March 27 2015 - Approved!

I filed online, so both. The NOA1 was available after 1-2 days online - it generally takes a couple of days for the actual letter to show up as a download.

Paper-copy of letter took a couple of weeks to arrive in the mail.
