I followed the instructions you kindly provided me before and since you're busy I summed it up below, Please provide me with your input:

 

- I filed (I-360, I-485 & I-765)  and fees were waived more than 5 months ago......    I wanted to file I-131 for family medical emergency

According to I-131 instructions there is no fee with a pending AOS

 

THE PROBLEM

1- I applied for Advance Parole based on the pending I-1485 with copy of my 797C NOA, it was rejected because it didn't include a fee

 

2- I applied again with the I-485 NOA and even a I-912  fee waiver It was rejected again!

 

3- I called USCIS customer service they told me I shouldn't pay a fee so I applied again (this is the TIRRRD time) with I-131 & copy of my 797C and still put in I-912 and copy of my Medicaid (listed as means of tested benefit).

 

Guess what, I went to infopass to inquire and they told me it's been rejected too!!!!!!!!!!!! what the heck am I doing wrong I included the necessary proof of AOS which should be enough!!!

 

 I called customer service again just a moment ago they told me this is very confusing to them and states AS of Jul 2007 anyone who applies for I-131 based on a pending AOS is NOT required to pay a fee!

 

 

 

There is no fee regarding form I-130 if you submit along with AOS, if you submit separated then you have to pay the fee.

 

You probably made some mistake when filing out the form.

Level 2 representative just called me back she told me I filled it out correctly however at the officer's own discretion they think (if an applicant wants to travel overseas) why not pay the fee too!!!!

She advised me to resubmit for a FOURTH time and just  add more  documents or bank statement or proof that I borrowed money or have low income.

Basically I should also be more in debt to pay them as well! it's a bit ridiculous given that I clarified it's for  medical procedure not travelling for fun anyway I am also waiting for the doctor's letter too then will try to get that fee covered if no other way. :(

If you submitted the I-485 form after VAWA approval then the AOS goes to Vermont first, then Vermont ships the case to NBC and NBC  ships to the local office.

just called Call center for the first time - they said that case is in VSC and I have to write to them to make a decision.  That is strange since local office in TX requested the RFE and required me to send it back to them at local office.  Now IO on the phone is saying the case is back in VSC

Anyhow- I am praying hard that this they are able to make a decision soon.  Please I ask you all for your prayers - Lord Jesus hear my prayer.

Im.sorry im also reading some forums in spanish and didnt think about writting in english, thank you for the translation and the amswers. 

Sandra i do understand that vermont ships to nbc then to local office but mine was sent on december 5th to vermont, receipts say dec 21st, then feb 13 got an update saying it shipped to a different office and letter said it was to nbc, but the machine says it is in vermont, so i am not sure if they sent it back to vermont after it was already on nbc or what happened, also you said it takes 30/40 days to ship to local office and since feb 13 til now is almost 90 days, is that normal or do you think it is already at local office, do they send any further notificacions or just wait for the interview letter?

I know i need to be patient but as i told you before i have medical condition that was affecting me big time, i wanted to fill an application to expedite but ny condition just changed, o got a job offer and would have to move over sea inside of united states but still 8 hours away flight, and i will hve to move next month, so im a nervious wreck right now because i dont want to change address and make a longer wait, but if i leave like this i will be worry all the time not knowing how far or near is the interview. I wonder why dont they update their procesing times at least to current month

You should state that you have no assets or savings. If you are unemployed mention that you have ZERO INCOME, if you work then mention all your expenses such as rent, food, transportation, utility bills, phone, insurance etc...You must state all these things in the I-912.

 

If you are living in someone's home then ask the person an affidavit stating he/she is providing you room and board since xxxxx till present date.

 

Mention in the I-912 that you are not traveling for pleasure but for an emergency, explain well and attached a letter from the doctor if possible.

I am also actively applying for work & have correspondences from employers (requesting university transcripts or interview information or rejection letters...etc.) should I show that?

Clearly, the IO has no idea what he/she's talking about.  You don't have to ask VSC to make a decision.

 

If you got a message saying your case is with NBC then the case left Vermont and the case WILL NOT  return to Vermont anymore.I believe your case is already with the local office, but the bad news is that your local office is adjudicating the cases received in October 2016, then you have to wait for at least 4months to have your interview.
