Hello everyone,

I am an immigrant woman in deporation procedure . I married to a usc but separated , also have a pending i130.

i left my husbans because he was abusive  to the point of death treaths .

My question is , if i file for vawa , can he find out? I was told by lawyers that its a confidential process but i am still

sceptic . My husband is an immigration attorney with connections in the justice system . Can it be possible

for someone who knows how to work the system to find out about a vawa petition?

My greatest fear is not deportation it self , but detention prior to that. Im the single parent of a child who is also an immigrant , and my husband told me many times he will have me detained for months in ice custody and that my child will go in foster care.  I need honest and and objective answers , even out side the box . Can someone sneaky , clever and familiar with the system find out about a vawa petition? 

 
 
 
 

He will not find out if you file a VAWA petition. It doesn't matter if he has "connections", USCIS will not disclose the case with him at all. You are in removal proceedings then you should find a Lawyer to help you with the VAWA case.

 

Do not disclose information about your whereabouts on Facebook. Tell your family and friends  not to answer his phone calls or emails. If he is the  father of your child then file for custody ASAP, if you share custody of the child with him then you can't just disappear. Find a lawyer to help with this matter as well.

Hello Everybody, my first post here. I have been a visitor of this forum for the past two months. I recently applied for Vawa through my attorney. I have a few questions.

 

How long does it normally take to get the receipts from USCIS once they have received the application package?

How long does it take for the whole process to take till a decision is made?

 

According to the processing times i see on USCIS they are processing cases from May 2016 (updated on Feb 28, 2017). Which is approx 9 months + time from Feb 28 2017 till now so add another 2 months and a few days... so all together approx 11 months to a year? Did I calculate this properly?

admad, you can refer to the previous posts under this thread which will give you a lot of information. Right now, USCIS is dealing with cases filed in July and August, so you need to wait at least 8 months to get your case adjudicated.

Takes 3-5 weeks to receive receipt after filing your application. I received mine in 3 weeks. And received prima facie soon after the initial receipt came in.

Based on logistics, takes approximately 8/9 months to adjudicate if you receive no RFEs. They are currently processing August 2016 applications.

Today after working on my VAWA case for more than 1 year and a half, I have finally received the APPROVAL from USCIS !!!! I am still finding it hard to believe it and feel like I'm dreaming. I am so grateful to God and to my attorney.  Praise the LORD!

Congratulations! Pls post your timeline. Did you receive RFEs? Why did it take so long?

Yes ahmad, it takes aprox. 12 months on average. If they send out an RFE's ( request for evidence) it's gonna take longer. Also it could take less if all is clear for uscis and you don't get an RFE. My case as an example - I filed in June 2016 received RFE, they confirmed receipt of my response in August and as of now I'm still waiting for their answer.

Take everything you read here wih a grain of salt. Not everyone who expresses their opponion have the capacity to do it. 

As regards the receipts, it should not take longer than, I would say, 3-4 weeks to get them. In my case it took 2 weeks.

11/28/2016 USCIS rejected my packet (expired forms) :(((  

11/29/2016 Mailed my packet again Via ExpressMail (I-360, I-485, I-864w, I-765, I-912, G-325A) with previous rejection notice on top & a request to expedite EAD

That is wonderful. I am happy for you. This is really encouraging and I know that all of us will get approve in Jesus name. The Lord sees all that we have been through.
