C31 doesn't mean VAWA approved. When someone files form I-751 category C31 the person will obtain the work permit JUST AFTER VAWA APPROVAL.

Good day Sandra, I hope your weekend is going great, so far. You are our rock, and I truly appreciate all you do. You're blessings will be constant and insurmountable. I filed vawa in September 2016, submitted AOS package in February, I received my EAD in March without doing biometrics. Last month I received biometrics request letter and I did the biometrics. So far I haven't gotten an update. Do you think the reason for them requesting biometrics after issuing my EAD, is because my vawa was approved? 

 

Before filing  vawa, I had previously filed to adjust status with my abusive husband. I had received EAD in October 2015 and gone to AOS interview in March 2016. We were split up, and were told to wait a few months for them to make a decision. He went back to an interview by himself, speaking against me, even though he knew how he was being at home towards me. 

 

I asked for a divorce in August 2016 (GC still hadn't come yet), he was being more abusive than ever, and I was afraid he would do something that I couldn't recover from. He said he told them to wait, because he wanted to watch me. In consulting with a lawyer, and playing a tape for her, she told me to file VAWA. 

 

Do you think them requesting biometrics is due to my VAWA being approved?

@Cindygodisgood1 if your spouse is a us citizen & you filed i-485 as well the right category should be c9.

You can submit s new form i-765 with the right category to get your EAD instead of having to wait for VAWA approval.

Where I live it can be obtained at the sheriff/commissioners office or through the court. You go in there, fill out the forms... At the commissioners office, the order becomes effective immediately while they schedule you for the first court hearing. You might want to call your sheriff's office at your county and make inquiries

To file a Family Court Order of Protection, it is best to go through a lawyer or domestic violence agency. They can help you file the necessary forms to prove that you are in need. Many DV agencies offer battered women's shelters for women suffering from domestic violence; this may be an important first step for your or your children.

Criminal restraining orders are similar to family restraining orders, but they are filed against individuals who have been arrested or who have a warrant out for their arrest. If you have been abused, assaulted or otherwise harmed, you may file for a restraining order through the New York Criminal Court.

My EAD card  c9 category came in the mail yesterday with the new features as announced by uscis/dhs. Happy for the support, guidance and prayers. Now searching for jobs begins. Praying for everyone in this process and hoping that our cases move on smoothly.

Below is my timeline:

Feb 17th- I360,485&765 delivered at Vermont.

March 16th- i360 rfe bona fide marriage

March 29th- I485 bio metrics

April 5th- rfe delivered.

April 25th- We ordered your new card notice.

April 28th- We mailed your new card notice.

May 4th- EAD Approval letter in the mail

May 6th- EAD received in the mail

Hello everyone,

I am an immigrant woman in deporation procedure . I married to a usc but separated , also have a pending i130.

i left my husbans because he was abusive  to the point of death treaths .

My question is , if i file for vawa , can he find out? I was told by lawyers that its a confidential process but i am still

sceptic . My husband is an immigration attorney with connections in the justice system . Can it be possible

for someone who knows how to work the system to find out about a vawa petition?

My greatest fear is not deportation it self , but detention prior to that. Im the single parent of a child who is also an immigrant , and my husband told me many times he will have me detained for months in ice custody and that my child will go in foster care.  I need honest and and objective answers , even out side the box . Can someone sneaky , clever and familiar with the system find out about a vawa petition?

Hello, once you file for vawa, It is strictly confidential. It is between you and Vermont OR between you, Vermont and your lawyer on file who will or may represent you. Other than that, it is against their ethics to release information to any other person. just make sure to receive your mails discretely and in a safe location, so that he has no access to them.  Also try to file as soon as possible so that they can put you on deferred status and place your deportation proceedings on hold.

@Greenspirit Make sure you are in a safe place which your neither husband nor his friends know. VAWA is confidential they don't involve the abuser or even share information with applicants themselves over the phone only (if you have an attorney on file or congressperson may inquire).

Like @Hopeful diva said you should secure your mail (lawyer's office or safe address).

 

  • Here is another tip I learned; DON'T FORWARD MAIL from the old to new address, people can easily find out your new address if mail is forwarded there.
  • If you need affidavits from mutual friends don't give them details or mention VAWA for your safety, so he doesn't come after you but just so you know even if he finds out, there is no way for him to access or dispute your case.
A friend went and told my husband and gave him my new number, I was afraid but the lawyer told me there is nothing he can do luckily she only had the lawyers office info to send her affidavit not my address.
