Hi .. need help today i went for infopass and i lost my old passport which had US Visa exp 2018 and the current passport with me .. im worried if at Green Card interview if they ask my old passport to check my visa then what im gonna do. I filed report with the Police in the Mall Parking and they gave a copy of that .. do i have to srnd this report to vermont with i 485 so they know it .. anyone in this situation pls help also i forgot to put my apt no on my change address so the IO said that if i change on AR 11 online it will update on all pending documents i 360 also...

I have an infopass  appointment coming up to inquire about my case & Advance Parole.

My Prima Facie will expire in 6 weeks should I submit a request for extension in person since I am already there or wait & mail it later when expiration date is closer?

May 2016 retained an attorney and started to prepare my VAWA petition.

11/28/2016 USCIS rejected my packet (expired forms) :(((

I am a vawa applicant myself and awaiting approval. I filed September last year and got RFE for good moral character. I will very much like to discuss with you privately via email so you put me through the remaining process. Sad to say but the attorney I got doesn't even remember me every time I walk into his office nor does he remember my case - they just treat immigrants like cash cows.

Vawa standard is different from the family petition. I had hundreds of cases where the victims did not submit a single document showing commingling finances and they were approved. A person proves to USCIS that they have a  bonafide marriage showing they intended to establish a life together at the time of marriage, because of this USCIS issues thousands of RFEs every year, because VAWA filers fail to describe the Courtship in details.

 

In the Vawa cases, USCIS adjudicators consider all of the available evidence. They are not looking to find just primary evidence such as commingling finances, police report, hospital records etc. A VAWA CASE can't be denied because the self-petitioner did not submit a specific document. The IO will consider all credible evidence.

USCIS will not ask for the old passport to check any visa. In Vawa cases even those that entered without inspection can adjust status. Just take the police report with you when you have interview.

 

The IO gave you wrong information. To change the address in your I-360 you MUST WRITE A LETTER asking to change the address and you must NOTARIZE.  Keep in mind USCIS  is terrible updating the address.Wait 10 days after you submitted the letter and then go to infopass to confirm if they changed your address ok.

 

File a new AR11 regarding your I-485 to reflect the correct address.

It's not advised to submit documents that USCIS did not require in the  RFE.

 

If later on, USCIS  ask proof of the abuse then you should submit the final restraining order.

infopass will not accept your letter requesting the prima facie an extension.  You should submit the letter to VSC.  Submit a copy of your prima facie ok.
