It said that I have assault 3rd degree. When I call police he was screaming that he would kill me now and plocice heard this through the phone and they asked me if he has some weapon, but I didn't put this in report, I was scared that he would have been arrested for more. His case was dismissed , I don't know why and he contact me through my friend when we have Oder of restriction and asked to take off with the help of his layer , and I agreed because he was acting again so nice . So we had to have from April till October but had only two month. Now he is talking that this arrrest was fake. I also have a lot of very bad massages from him. He turned my iphone off ( it was on his name ), he thought if he will turn it off I will not be able too see text massages. But I can still see them and have some recording of phone calls where he is threatening me .

actually I also don't have any document that confirms his citizenship birth of certificate or passport or naturalization card, I went to layer and layer said try to get from him, but I'm scared even to go to any contact with him. He gave me iphone and next day reported it was stolen, then he was harassing me, text my friends bad stuff, texting me non stop, coming to bang at my friends doors, and then he went to police and reported that I'm harassing him, I even didn't go to any contact with him. I don't know how police taking such reports without any evidences . He is sick on his head I don't know what to expect else from him.

I left him and was scared of him , he was harassing me, asking my friends where I am, going to places where I was visiting just to find out when I was there. I was very scared but didn't want to make Oder of protection or call again police because it could make him even more mad. Now he understand that I'm not going to come to him back and he sent me too much bad massages and phone calls , where he is threatening me, controlling , offending . And he is scared that I can apply for this Vawa and he started first threatening me to call usics to tell that it was marriage fraud, then he start threatening me to send letter to homland security. After I found out from his friend from childhood that he has very bad case of some mental illness which he doesn't accept and doesn't want to take any medication for. 

Now I don't know if I have enough papers for Vawa - he had his own co-app and never put me in list because he was scared I can got it, I never worked he was supporting me , he was paying for everything so all bills were on his name, and he wanted to do me with him some credit card but he never did because I had some missing documents which bank required .  All we have is dental insurance under his name , joint taxes, and pharmacy cards insurance . He applied several times for my medical insurance - but first time he sent wrong letter, second they didn't tell that they need social security number and they needed it. 

Is these papers would be enough for a Vawa? 

I just want to try if I have any chance for Wava or got divorce and forget about him like about a horror dream. I'm living in constant fear almost like for more then a year now.

Iraaaa If you  fear for your  life get a restraining  order against him again. DO  NOT DISCLOSE  your  address with  any of  his friends.

 

You  should get a copy of the documents  showing the assault caae and even the dismissal  order.

 

If you  don't have a place to stay go to a shelter for victims  of domestic  violence.

 

DO NOT CONTACT  HIM ANYMORE! !!!!

 

If he was born in the U.S  contact VITAL RECORDS  to obtain a copy of his birth  certificate. 

 

If he doesn't know where you  live there is no reason for you to be afraid of him,if he knows where you  live then  move to a different place.

Thank you very much ! Can u offer me some good attorney or layer for Vawa case. I live in NYC area. If my layer doesn't even know that I can obtain his birth certificate through Vital Records.

I didn't have my husband's birth certificate either I ordered it from vitalcheck.com.

 

you don't need a lawyer to file vawa if you gather the documents supporting your affidavit,  but if you do decide to hire a lawyer you should research him/her specially experience in VAWA cases.

Sandranj, a very good morning to you. I just registered so I can comment and contact you here. I do read this thread and I am very much impressed with your knowledge of the process and how you have been able to help others. I really hope all your efforts never go in vain. 

I am a vawa applicant myself and awaiting approval. I filed September last year and got RFE for good moral character. I will very much like to discuss with you privately via email so you put me through the remaining process. Sad to say but the attorney I got doesn't even remember me every time I walk into his office nor does he remember my case - they just treat immigrants like cash cows.

If she's not a lawyer she knows a lot more of this process than many lawyers I've spoke to that's for sure .

I think she is ,I been reading a lot of her response and she knows a lot ,it's nice to find person like Sandranj ;praying for all cases,hopefully we getting approve soon; God bless you all!!
