1- To change your address you should send form AR-11 to Vermont Service Center https://www.uscis.gov/ar-11

 

2-   3 Months is too long, keep your postal tracking number & you should call customer service and request to speak to teir 2 officer (2nd level officers to provide a receipt number) (call early so you can be transferred instead of scheduling a call back days later)

Hi Sandranj, I have one question for you.

I have got my primary facie evidence in mail. I need to travel outside the country for medical reasons. Doctors think that I am liability myself and thus suggest hospitalization or travel to family. Or they coming here.

 I don't have money for hospitalization no I can call someone here as I don't have job and nor I can travel. 

I have asked USCIS to expedite the case but haven't heard anything from them.

And my lawyer is saying that we should not file I 485 and i765 together instead just file i765 .

What do you think should I do to either get case expedited or get ead. Is it true that you can get ead on pending vawa. The only reason for ead is so I can keep job and be on a medical leave and have some family come here.

 

I desperately need some help. I am going crazy.

You can file I-765 for your EAD and get it while VAWA is pending but only if you apply for I-485. To apply for I-485 now, your spouse has to be a USC. If you decide to file both, I-765 should be with category c(9). 

Remember that if you do decide to apply for I-485 now and your VAWA gets denied your I-485 will automatically be denied and you will more than likely be put in removal proceedings.

You CANNOT CHANGE YOUR ADRESS ONLINE regarding form I-360, you MUST SEND A LETTER to Vermont to change your address, but without a receipt number, this is impossible.  Set up an appointment with infopass and go there to inquire about your receipt.

 

USCIS CANNOT give information over the phone regarding a VAWA case!!!

Thanks for that clarification. 

But my other question still remains that how to get the vsc to expedite the case. I have read that once you request they inform you if they accepted the request or not. It's been weeks and I haven't heard anything can I ask congressman to enquire on my behalf.

Gramercy your information is not correct ok. 

 

A person CAN'T CHANGE THE ADRESS ONLINE regarding form I-360, the person  MUST SEND A LETTER to Vermont to change the address.

 

USCIS CANNOT release any information over the phone regarding  VAWA, if a Tier 2 officer gave you any information over the phone regarding your VAWA the IO can be punished by USCIS for that, the officer is subject to a civil penalty of $5.000 for each violation. The  Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA) section 384 states:

 

"... The governing statute prohibits the unauthorized disclosure of information about VAWA, T, and U cases to anyone other than an officer or employee of DHS, the Department of Justice (DOJ), or the Department of State (DOS) who has a need to know."

 

As you can see not even the self-petitioner can receive any information about the VAWA case, over the phone.  USCIS releases information if the person goes to infopass and USCIS can inform the Congress Person inquiring on your behalf about your VAWA, but you have to sign a form authorizing USCIS to disclose about your case.

To ask VSC to expedite your case you have to mail them and submit proof that you qualify to have your case expedited. If they decide not to expedite your case they will not inform you ok.

I didn't advise the member to submit a new address online!

I specifically said "send form AR-11" to Vermont Service Center"  & provided the link with instructions. I realize VAWA petitioners cannot submit inquiries or requests either by phone or online & it explicitly states that on the linked page as well. :)

Gramercy my previous post is missing this part "The person SHOULD NOT SEND FORM AR-11 TO VSC, the person MUST SUBMIT A  NOTARIZED LETTER TO  VSC asking to change the address.

Folks often I receive pm and emails telling me they had a lease agreement, joint bank account, health insurance/car insurance etc, but they don't have proof of these documents anymore. Look you need to submit the best evidence available for VAWA, but sometimes you do not have the evidence available then you should EMAIL  the former landlord, the car/health insurance companies etc and ask a copy of the document needed, and if they fail to answer you at least you can explain to USCIS  that you tried to get the evidence, and submit a copy of the email showing your attempt to get the document, this kind of proof can  help you.

 

Do not submit just a copy of the tax return filed jointly, but a COPY OF THE IRS TRANSCRIPT.

 

Explain to USCIS why you did not have a  lease agreement, tax returned filed jointly, joint bank account, credit cards, utility bills in both names.
