I don't think you can do much based on an assumption that he "will pull out his affidavit" since he may still leave it pending, you will know if your AOS is denied.

You may file a self petition under VAWA if you are a victim of abuse.

If you file VAWA, request to hold your I-1485 until a decision is made about your petition OR if your spouse actually withdraws his petition then you file a new one.

Thanks for the reply Gramercy! Yes, I am a victim of abuse and I'm to file for VAWA. My husband called me to tell that he will be cancelling my current AOS petition. My interview is scheduled for next month. Now the issue here is that he wants to see me suffer, so he may file false claims that I married him for GC. How do I get him punished for telling USCIS lies?

1- He just threatened you, you don't know if he actually made those claims or reported you

2- I know many spouses withdraw their petitions  & make allegations, I never heard of anyone get punished, so I really don't know!

How come you suffered abuse, but your goal is to punish him for uncertain claims that aren't officially made yet?

 

I think freeing yourself from the abusive relationship should be your priority & can only advise you to focus on your own petition and file VAWA asap & include proof that your marriage was entered in good faith.

01/14/2017 Mailed my husband’s birth certificate with the blue receipt that came with my Prima Facie

01/12/2017 Biometrics completed

They usually issue receipts 2-3 weeks after submission. Sometimes it takes up to a month, you are almost one month since submission. You may want to check in with the charity lawyer to see if she received it yet

I once travelled with a B2 when my i485 was pending and it was denied. If they find out that you used your b2 to enter instead of your AP, your i485 may or will be denied. It doesn't fall under inadmissibility because immediately the officer denied my application, she told me to reapply as soon as possible. Once you travel without AP or you don't present your AP to customs and you have a pending i485, it is considered that you abandoned your application

Don't worry, while notices typically come within a month but a couple of people here who filed in 2017 experienced some delays, one got her NOA after 50+ days.
