I have read some sample RFE's sometimes they ask the applicant so explain the hardship they experience as a result of the abuse and how it affected the victim's life.

Gramercy there is no hardship in VAWA cases, just for VAWA cancellation of removal. Maybe you meant to say that USCIS asks the person to explain the abuse in details.

 

I see often psychologists mentioning in VAWA cases about hardship and that USCIS should allow the person to live here, as I mentioned before there is no hardship in VAWA cases. Many psychologists submitted psychologist evaluation for asylum cases, and of course, in asylum cases, the person must prove hardship, and many  professionals get confuse mentioning hardship in the psychological evaluation.

Today I got two messages asking me about to expedite the AP.  You can go to infopass to ask for EMERGENCY ADVANCE PAROLE. Despite USCIS published the person can go to their office bringing form I-131, 2 pictures, and the USCIS fees or waiver, I noticed that many  USCIS offices do not accept this and they ask proof that the I-131 was submitted and proof of the emergency(doctor's letter etc..). Almost all USCIS offices will be able to issue you the AP same day.

Emergency Advance Parole

USCIS field offices are authorized to accept requests for emergency Advance Parole for the most urgent circumstances. The agency reviews these requests on a case-by-case basis, and the USCIS field office director has discretion to grant or deny them. Requests should include an explanation and evidence of the emergency. An Immigration Services Officer has the discretion to request that a currently pending Advance Parole application be expedited rather than issuing an emergency Advance Parole document.

In most cases, InfoPass appointments are used to request emergency Advance Parole and Form I-131 can be processed the same day if the individual submits the completed form, appropriate fee, and supporting documentation. The Ombudsman understands that avoidable emergency requests, or those due to applicant delay may be denied. Emergency Advance Parole requests granted at the field office may be granted for a specific period of time, and will have no effect on Advance Parole requests already pending with a service center.

Advance Parole does not guarantee entry into the United States as foreign nationals are subject to inspection at ports of entry by Customs and Border Protection (CBP). For more information, visit the Advanced Parole section on CBP.gov.

Yes, it wasn't. They needed more details"how did it happen? when? ". I edited my affidavit, I think they need more details and dates in it.

My husband was texting me all night and day, with very bad messages, such as "I will kill you, or rape you again, I will come with my friends and will rape you, you will go home soon ...etc...". I have about 100 such messages. And voice mails as well. A police officer called him and left a voice mail, and I think he got scared a bit. And of course, he got a restraining order. I was stupid, I didn't go to the police when he hurt me, and when I had bruises, I was scared a lot. And he made me cry in the middle of downtown, again was stupid do not call to police. So, I put everything together, edited my affidavit, and that's it. I was very very detailed, dates, actions.

Was it a temporary or final restraining order? Looks like your affidavit was more of the problem than the restraining order evidence that you had submitted.

Yes, Affidavit had a problem. I was very stressful, and could not do anything. To write everything in details what he did to me, it was hard. Its like refreshing everything again and again. It was terrible.

Yes,  the hardship I mean is the effect of the abuse on the battered spouse to explain how she suffered as a result & the way it impacted her life.

(1) Go to the local police in place you lived 6+ months in the past five years, to ask for clearance.   OR

(2) you can also obtain a personal public record from your state, they take your photo & prints and mail the information within 1-2 weeks (process & fees my vary by state)

@sandranj I did call the uscis and requested to speak to a level 2 officer, I explained to him everything about my earlier i485 denied due my spouse withdrawing her i130 petition, and I've a notice for an interview for that same denied petition. He told me on their system it shows the same to appear for the interview and assured me not to worry about the denial notice. He added that I should expect in the mail the interview instructions.

At the moment I'm not okay with this answer. My next step is to set an info pass appointment to clarify my confusion and doubt.

I would go to the interview regardless  of what infopass will tell you. 

 

One girl  member of this thread she went to the interview and the officer said her VAWA wasn't approved yet but  he would approve the case,something I never heard before, days later she got the GC. The officer screwed up and issued the GC valid for two years, she had to file l90 and they  mailed the right one.

Hi Everyone: This is just a heads up so no one shares info or falls for this.

 

I received a horrifying call today, a lady called claiming to be an investigation officer from IRS said they sent me mail and since I haven't responded there are three charges against me and a warrant shall be issued for my arrest, we got disconnected I called back in panic?

My concerns were: I lived as a ghost and never claimed anything or filed  anything since I was out of status and why didn't I get that alleged mail???

I remembered sandranj said anything before filing VAWA doesn't matter & what counts is once you file so I was so confused!

I had a meltdown she said she will try speak with her superiors to help me. then asked if there is an amount I am able to pay now from the few thousands I owe!!!  I explained to her I have nothing & no means so she told me to calm down and that I won't be arrested just look out for the mail in 15 days and respond promptly to clear up this matter!

 

I was scared but things didn't add up so as soon as she hung up the call I started to google this came up even before I finished typing "IRS called me about a warrant"  it's a scam targeting people specially with foreign names (immigrants scare fast I guess) I didn't think much of her indian accent until a report stated some operate using magic jack in india!

This has been on our local news for the past two years.  I got the phone call twice.  I just laughed and hung up.  The IRS never calls anyone.
