Happy day!  My EAD card is being printed as of April 19th.  I just got 4 text alert from USCIS in the middle of the night.  Happiest I have ever been to be woken up in the middle of the night.

Apart from working does anyone know if I can apply to go to school with this?

Hi -here is the full details:  It lasted 10 mins.  It was an older lady (60's) Officer Godard.  She made me swear in and repeated all questions in the I-485.  She then asked me if I was married and I said no and she took a copy of my DL, Passport and divorce cert.  She asked how I entered, the last date of entry - I answered.

She then smiled and said 10 days is when they will let me know the decision - she asked if I left the US after the last entry I said no.  She asked if I worked - I gave her my offer letter, W2 and pay stubs thus far.  I also signed a waiver of attorney presence.

I then kindly requested that she changed my name on my green card back to my maiden name  - she asked why didn't I do this at the divorce- I said I was not at the hearing due to low funds - she looked at thee divorce cert and remarked she didn't realize he filed for divorce.  She asked why didn't I file for the divorce is said "Ma'am I was not in touch with him and I had no money to go through this procedure".  She said okay.

Today I checked my status online : It indicated my name was updated.  The officer did say she'd ask her supervisor to approve this.

Fingers crossed - hopefully I get the card in the mail.

When the officer says she will recommend you for approval, it means you are approved and she just needs the supervisor signature.

Question:  If you have not been given a Prima Facie letter can I request a determination on that?

Yes you can request a Prima Facie Determination. To establish a Prima Facie Case you have to prove:

(1) existence of the qualifying relationship; (2) the citizenship or immigration status of the abuser; (3) the self-petitioners eligibility for immigrant classification; (4) residence in the United States; (5) evidence that, during the qualifying relationship, the petitioner and abuser resided together in the United for some unspecified period of time; (6) battery or extreme cruelty ; (7) good moral character; (8) extreme hardship; and (9) and  good faith marriage.

In my cover letter I did not specifically ask for a PRIMA FACIE determination.  I was absolutely careful to send very good evidence (including documents) of all of those things in my initial application.  I checked each of them off.  Would I send a letter respectfully asking that they make that determination based on what I have sent already?  I am not certain how I would word it.

Hello, guys! I am happy to inform, that I have got a Green card. I cannot tell how I am happy now. I am holding on my hands, and still think that its not real.

I am sharing my timeline:

Applied for VAWA November 2015,

January 2016 requested  for additional  evidence

April 2016 requested again for additional evidence

August 2016 VAWA approved

January 2017 Interview

April 2017 got my green card in the mail.

It was the hardest time in my life. I didn't live- I existed.

I didn't want to eat, work, go out... I cried every single day.

I am super exhausted and willing to go somewhere where nobody knows me. I am going to move to different state. Just want to change everything.

I am still having a therapy with my doctor. I have nightmares, and I have fear to go out from my apartment alone.

I hope everyone who starts VAWA, will win this battle.

Thank for everyone, who answered my questions here.

I wish everyone here will find a real love and man, who ll love and never hurt. I still believe that I will be happy, no matter what.

God bless you, guys.

If your Spouse is a USC you can apply for I-765 & I-485 and perhaps a letter to renew your prima facie.

After been reading old posts, I renewed my faith. I think  I have chance of being approved. I will risk and apply for I-765 & I-485. I will also have more patience in my waiting. Thank you!

Bless you on your journey and good luck.  You can and will heal a little more and more each day.  I don't always have nightmares anymore.  I sometimes even get a full night's sleep.  I have had a lot of therapy from two very excellent therapists.

They asked for more proof of abuse? You mean the restraining order you submitted was not enough?
