As I  said before just the petitioner can ask to expedite the VAWA/EAD/AOS.The Congress person has no authority to do this, they just inquire about VAWA/EAD/AOS when is outside or normal of processing time, NOTHING ELSE.

The person can  write a letter to USCIS asking  to expedite an application if it meets one or more of the following criteria:

Severe financial loss to company or person ;

Emergency situation;

Humanitarian reasons;

Nonprofit organization whose request is in furtherance of the cultural and social interests of the United States ;

Department of Defense or national i nterest situation;

USCIS error; or

Compelling interest of USCIS.

Hey everyone! I don't know where else to post!

I’m applying for citizenship using the three year rule based on VAWA. In 3 weeks I will be able to submit the n-400 I’m doing everything myself and wanted some feedback from you guys.

I’m currently working on the cover letter. I know in the cover letter I need to explain the three year rule and attach the 89 Memo . I have a record.

Do i have to submit evidence of the marriage?

Could anyone share their timeline?

I can’t afford a lawyer and I’m nervous I’m going to miss something.

thanks!

CZRRRR long time man. Yes, you have to submit prove of bonafide marriage, IRS transcripts, and a certified copy of the deposition transcript.

CZRR your charge does not preclude you from obtaining Citizenship but USCIS does not take slightly this kind the record that you have and they might consider you lack good moral character. Make sure that in your cover letter you explain the circumstances surrounding the charge.  Explain why you entered in the car and mention you were fleeing from abuse, as you mentioned in your VAWA case. Be very specific and you don't have to write down one page.

Mention nobody got hurt, tell then it was your first and only offense. Mention about your professional life before and after the charge, are you still waiting for the State? it's a good thing tho. They will have the transcript in front of them but it's advised to explain in the cover letter these points ok and apologize for what happened.

Hi,,, I submitted RFE for good moral character (FBI fingerprints)  it shows Vermont got it last Friday(check UPS tracking number),,  my question is how long before there is an update on my case online or they acknowledged on line that they actually got my RFE?

Sometimes they post the  RFE answer was received and sometimes they don't post ok. Their website is not reliable.

BKM if your spouse is a US Citizen and you will file for adjustment of status or filed the AOS then you can submit form I-765 category C 9 and you should receive the work permit within 2/3 months.

If you had your VAWA approved and didn't file AOS you can file I-751  and put category C 31, but if you have your Vawa approved it's advised to file for AOS, and  file the I-751 using category C 9.

Hi all,

Today I received the VAWA and EAD approval notice. I am so happy right now. I read some people have received the prima facie extension while they did not asked for it. So did I. Therefore, I want to share with you my experience.

I found out that my VAWA was approved in March through infopass. Last week, I received a notice for prima facie extension. I was surprised and wondered why USCIS sent me this without my request. So I contacted my congressman office. The lady at the office was really nice to me. She was able to get in touch with Vermont office and I think USCIS has realized that they sent me a wrong notice. After that, they sent the approval notice the day after my congressman inquired it.

I hope this helps other members who are still waiting.

To rayofhope,

I think for any concerns you have, you should talk to an officer at infopass rather than sitting at home and worry yourself out.

Below is my timeline:

May 6, 2016             I-360 sent

May 16, 2016           USCIS sent notice that they received my case

May 19, 2016           RFE requested

July 5, 2016             RFE received

July 8, 2016             Prima Facie issued

     2017

March 13       Congressman informed me that USCIS has made a decision on my case, they did not tell what the decision was though

March 31       Found out VAWA was approved on March 8 at infopass

April 10          Received Prima Facie extension

April 11          Contacted congressman

April 12         Approval notice sent from USCIS

April 17        Receive VAWA and EAD approval notice in mail

I was wondering the same. Maybe the time starts counting from when vawa is approved... This is a good question for sandra .
