You can apply for I-765 without I-485 but you will not get your EAD until I-360 is approved in that case. If you apply for both I-485 and I-765 (category c9) you will get EAD while you're  waiting for VAWA to be adjudicated but keep in mind that if your VAWA is denied and you have a pending AOS, it will be denied and you will face removal proceedings.

I received my EAD today!! So happy!! No prima facie until this day, so I'm assuming I will be one of the few that randomly doesn't receive it. 

 

Here is my timeline:

 

12/17 Petition sent (I360, I485, I765, fee waiver)
12/21 Receipt Date 
02/02 NOA for Receipt 
02/12 NOA for Biometrics
03/03 Biometrics Appointment
04/03 EAD is being produced
04/06 I-765 is approved
04/13 EAD received

Any body here apply for food stamps/SNAP with their prima facie?  how much do they give per month to an unemployed individual with no income?

Cash is around $200 and Food stanp is between $150-$175 depends on case to case

Hi, I am new in this forum. I sent my 360 form in September. I was married to an American citizen for 13 months (in the paper) and life together around 5 months. I left him 2 times and came back, and he spent 4 months in jail (for accusation of sexual abuse against his daughter). He was an unstable person that used to get mad at me for not reason. Most of the time, he was mental, verbal abuse. It also  had some situations that he was physical (but without left bruises).While he was in jail, I was going to a support group for victims of domestic violence. When he came back, he was nice again just for few days. Then, after 2 weeks, I left him again  and I came back to my sister´s house. He tried to persuade me to come back, very manipulative. It was the hardest time of my life. In my sister´s town they did not have a support group like they had in his city, but I started to see the domestic violence program manager. Through her help, I could started to have counseling with a clinical social worker. He has been working with woman like me for more than 20 years.Anyway, I have been divorced since March last year. I filed my papers by myself, I could not afford to pay an attorney. I did a lot of researches before sending them. I decided just send the 360 form because I was not sure if I had a strong case.

I did not have any police or medical reports. While he was in jail, I found out that he went fo jail few times in connection with domestic violence. I had a lot of emails that we wrote during the time we were separated, I sent affidavits from my social worker (It was the best thing I could got, not money for a psychologist), from the violence program manager, 2 friends, my sister and brother-in-law. I don´t know if were enough evidences, but it was what I had.

 

They received my case in September 29, 2016.

I got my receipt in October 12, 

My prima facie in October 15.

 

Since then, I have not heard from them. Everytime I check my status is the same: Fees waived.

 

This waiting time is not easy. Hopefully before a year they can send me an answer (a positive one). I know now I am not alone in this waiting process.

The previous one was denied because her husband withdrew his affidavit of support. We get our EAD's based on pending AOS. She has to have a pending AOS to be able to get EAD.

Actually that's not necessarily accurate. 1) One may still qualify to apply for new EAD only the approval process will be under different circumstances (vawa approval).    2) in her particular situation: She's filing all forms together so she is eligible!

You're welcome dear. It takes approximately 90 days for the EAD to be sent however if you qualify for expediting your EAD application you can wait until you get your receipt and go to your representative (congressman, senator, ombudsman) to request expediting on your behalf.

A couple of ladies here filed in July 2016 and got approved by mid Februay 2017 judging by that time frame I'm hoping your case gets approved soon..

note: some have been waiting for over a year so don't panic you can schedule infopass to inquire and also remember to renew your prima facie before it expires.

 

Did you also file for I-765 & I-485?
