No I did not file i765. I was advise by an attorney and he didn't mention I i765.

If you need to work you have to file I-765, if your husband is a U.S Citizen. The time that the person worked BEFORE FILING VAWA immigration will forgive, but to work without a work permit after filing VAWA  is a big problem.

If your estranged spouse is a US citizen, you can file i485,i765 and i360 at the same time. Without filing i765, you can't get an EAD. So you might want to go ahead and file that at Vermont since you already have pending i485. Just attach copies of your receipts for i360 and i485 when you mail in your i765 application

It seems  that she has an attorney then she should not file the form I-765 without talking to her attorney. Many attorneys will end the representation if the client contacts USCIS without his/her knowledge.

Thank you. I will contact my attorney first. I am surprise that he did not know that he was suppose to include I-765.

What could happen or be the penalty if they discover someone worked without work permit or with expired EAD after filing vawa and how do they determine this?

I've been previously instructed to mail everything to the office handling my case (Vermont Service Center)

If you have a pending VAWA case with them I think this is where you should submit your I-765 with!

It's forgiven what the person did BEFORE  filing Vawa not after.

Vermont does not  decide in admissibility  just the local office. Vermont adjudicates VAWA cases and the local office the AOS.Sometimes they  close their eyes and kinda ignore people  working without EAD  but the person can get a nasty officer.
