RSJ you can file Vawa but you must attend the interview and ask the IO to put on hold your I-485.  If your wife withdraws the I-864 your AOS will be denied and then you have to file  a new I-485 along with your VAWA.

Hi Sandranj,

Will it be important to send a letter to USCIS or I just wait for the interview and show up? Should I bring a printed request? Or verbal? What if my spouse shows up? I'm so afraid he can do things I never imagined. SHe's been telling me I haven't seen the worst. How can I discreetly inform the IO. Tnx!

If I send a letter to hold where is the address please? Tnx.

If your  wife shows up then probably she will withdrawn the  l864 and the  officer  will deny  on the  spot then just file a new AOS if this happen ok.

Tnx for your prompt reply. I meant the letter to hold, if I send it through mail so USCIS can receive it before interview date. And I would show up still. Would you know the address please?  This is one of the most difficult times I'm going through. Prayers for everyone here.

That lawyer is not serious. Why did he lie? I know it's stressful to keep waiting but hang in there. It will get the receipt soon.

I understand your concerns. So heres what I suggest. Set up an appointment through infopass for your local office (where you are going to have the interview). You should be able to submit your letter there directly in person. Since your case is currently with them at the local office I do not see a reason why they shouldnt accept your letter. But they may direct you to mail it somewhere (they would give you the address) or they may take it from you and upload it themselves to wherever it needs to go.

As for the actual interview date- like Sandra said you need to attend. If your spouse shows up- do not be afraid to ask the security guard for assistance. If there is no guard currently in the waiting room, ask at the window for them to have one come up when your spouse arrives. You should not and need not be alone in the waiting room with them. Explain briefly to the guard that there is an 'issue' between you two and you do not want to be alone with your spouse. They will keep you separate. When its time for the actual interview you can request to go in separately or go in together. Personally I would ask to go in first and speak with the Officer about the letter requesting it to be held. If your spouse wants to speak with the Officer still- then you can ask to remain in the room and have them bring your spouse in. That way youll be able to hear what your spouse states. If the Officer wants to speak to your spouse alone- well theres nothing you can do about it. But I wouldnt worry too much about what is said.

Really its going to be up to the Officer on how they want to handle things. The above is the way I would try to have it go, but anything can happen. If they insist on bringing you both in first- then go with it. Let your spouse have their say and at the end tell the Officer you would like to speak to them alone and have your spouse removed.

The important thing is to speak up. Make it known that there is an issue so they are able to work with you. If you dont speak up they can not help you.

How do you all cope with the waiting? I had to schedule another therapy session just to start working on the toll of this wait. I havent eaten in days and my husband will soon be out of jail, i got into a shelter finally but my progress will truly begin when i can work and provide for my daughter

I have severe anxiety too but I realize stress won't bring any results, it just eats up all my energy, I try to stop myself and stay positive & pray and ask others to pray for me.
