Brother and sister today i got a good news when i called the uscis  customs number one of the reps told me that. my i 360 was approved on the 19th of Jen 2017

i want to thank everyone here for the good job will are doing. working together  like family i pray others will get approved soon in Jesus Name Amen.

Dec 27 16 - EAD Pending

Jen 10  16 flied  I 485 pending

Mar 8 2017 Biometrics Appointment  done

Jen  19 2017  I 360 Approved

It doesn't matter if your husband's petition is withdrawn, you are still eligible to obtain EAD and since you already have a valid one you should keep using it only remember to submit form I-765 to obtain a new document.

If the application was withdrawn, doesn't that make the EAD related to that application invalid as well?

If her husband withdrew the I-864 and the AOS was denied then her EAD is considered null and void, and she has to apply for a new I-485 and I-765, even if the one she has didn't expire yet.

 It may take 5/6months to have your petition for naturalization adjudicated. To expedite you have to demonstrate that  one or more of the following  expedite criteria have been met

  • Severe financial loss to company or person ;
  • Emergency situation;
  • Humanitarian reasons;
  • Nonprofit organization whose request is in furtherance of the cultural and social interests of the United States ;
  • Department of Defense or  i nterest s ituation (These particular expedite requests must come from an official U.S. government entity and state that delay will be detrimental to the government.);
  • USCIS error; or
  • Compelling interest of USCIS.

You should send a letter to USCIS stating that you requested to renew the prima facie last month and until now the Service didn't issue the prima facie.

 

The prima facie is just for you to apply for benefits such as medicaid, fafsa, food stamp ok, but just 3/4  States grant food stamp.

Ok. I will. I dont get any benefits from it but its just something that i keep with me because its the only valid and current paperwork that i have. I sent my i360 july 2016. Got Prima facie on october 2016. Havent heard anything since. As far as time frame, should i be worried? I check my status and processing times all the time but nothing is happenning.

USCIS is adjudicating VAWA petitions  received in July 2016. Last week 4 people that I helped went to infopass and they found out that their VAWA cases were approved a few months ago, one person went to the AOS interview and she didn't know that her case was approved, two others had their cases already with the NBC.It seems that USCIS is screwing up big time.

 

Set up an appointment with infopass to inquire about your case and contact your congress person as well.

I'm sorry I misspoke earlier.

Correction: you're still eligible to apply for an EAD and since yours may be void you may request to expedite the process if you provide a valid reason.

 

@sandranj: thanks I stand corrected. I was obviously misinformed about the renewal.

Yes, you're right & she can't renew. However she's still eligible to apply for a new EAD (I corrected my previous message)

I don't think she's eligible to apply for a new EAD until she has a new I-485 pending.

 

The previous one was denied because her husband withdrew his affidavit of support. We get our EAD's based on pending AOS. She has to have a pending AOS to be able to get EAD.
