Hi Sandranj... 

thx for the andwer .. im little confused when i filed I 130 my son was minor(17) but my petition was denied as my husband didn't went for interview now wen i have applied for vawa my son is 19 and also he is on my vawa prima facie and i485 which was filed together if my vawa gets approved do i have to file i 485 separate for my son as others say as minor are included in the i 485 petition so i should not file separate AOS for him.. ... pls tell me as its almost 6 months now and also if i have to file separate i don't have money to file..,

It was mentioned here before in some cases the applicant doesn't get a prima facie for some reason! 'm not sure why. But if you received the NOA

check on your case using those receipt number and write them to inquire if needed

Don't panic, you received RFE and your file wasn't returned to you so case wasn't rejected.

@gramercy. Thank you. I got the Receipt Number but haven't heard anything since they got my additional evidence.

I finally got my RFE today and they're requesting that i prove that I entered my marriage to my abuser in good faith on my i360. I sent it with copies of the ff:

Marriage license 

Joint bank statements

Joint lease with both of our names

Pictures

 

What can I add or what should I add again to prove that my marriage was in good faith?

 

Please I need help with my RFE?

It would help to include a letter with information about how you met and started dating and things you did together which lead up to marriage and how marriage was. Just to make sense of the situation.

Affidavits from mutual friends would be an additional asset, to give your statement credibility if possible.

Timeline:

11/28/2016 USCIS rejected my packet (expired forms) :(((

Then it is just taking time & status doesn't change for months.

If you need the prima facie to apply for benefits like Medicaid you may write them to inquire or better ask your representative to inquire on your behalf.

Thank you so much I can write up a letter to add up but my fear is getting in touch with our mutual friends for affidavits. I don't know if they'll inform my spouse that I asked that from them, I'm very skeptical and a bit scared about it.

The friend who introduced me to my husband did exactly that!!! she went straight to him with my information, but it was a risk I had to take since I was desperate, my lawyer told me it shouldn't affect your case, since it's a self petition and doesn't rely on my husband statement in anyway.

 

Even if the spouse finds out, they have no access to information about your case. just be try to be careful that your spouse doesn't harass you or try to harm you again.

You're pretty much on the right path. Just add your personal statement about your marriage and how you met your spouse etc

If a mutual friend agrees to help out prepare their affidavit for them so you can just meet them and have it signed to move on, it's just a truthful statement to support you in a legal matter, no one needs to know its for vawa.
