I filed my VAWA on January 2016 and got prima facie. I have a prima facie extension given to me just this august 2016. My husband is a US citizen....

 

1.) What paperworks can I file to adjust my status? And get Employment card? 

 

2.) Is it a wise decision? Because i heard that if you do this and your VAWA not approved you will get deported? 

Yes if you file AOS and the VAWA is denied you will be removed from the U.S

Hi Sandranj, 

my case is pending for more than 10 months and my second prima facie was issued and (no rfe till now )after request and again its going to expire in Oct which means it will be a year. I dont know whatto do as my daughter will turn 21 on December who is derivative as she is on my AOS so i have two ques 

1) if my case is not adjudicated by Dec the n i have to file her separate AOS 

2) my work permit will expire in April 2018 so i have to applyfor renewal in Oct 2017 or should I  Contact  Congressman or should i directly write a letter to VSC asking whats going on my case . Im worried as if i again ask for prima extension will they again issue and take next 6 months again . I cannot sleep as its taking too long as i was hopeful that i had filed in Oct 2016 and as they are working on October so im now nervous what should i do. This stress is do painful i cant sleep anymore pls advice...

You daughter qualifies to receive the GC if when you got married she was under 18,otherwise she doesn't qualify as your derivative. She won't be able to get green card in the U.S if when you got married she was over 18 years old.

 

Go to USCIS to inquire about your VAWA. File I-765 now cause they are taking 3 months to issue the RFE.

 

Prima facie is used to get medicaid,and a few States issue food stamp.

Yes Sandra i got martied when she was 17 and also she was on my i130 petition so if she turns 21 then do i have to file separate i 485 for her or i have to do nothing . Also in Oct 2017 it will be a year as filed vawa in Oct 2016 . We are also getting Snap benefit as i work part time as didnt get full time . This time if i dont ask for prima facie ext  vsc will do automatically as in few cases i saw they didnt demanded extension still they got it. Im worried as i have to apply again for my i765 renewal 6 months before its getting expired in April 2018 and it takes forever to renew nowadays.

thanks for being helpful as in todays world nobody is helpful..specially i have never met anyone so far...

i applied my vawa in feb 2016 only i360

received rfe for good moral character in april

responded to rfe in may nd i received my prima facie after 1 week.

my question is i married to a us citizen. can i apply for work permit by the time i receive any response from uscis. if i can apply, under which category i can apply?

pls help

@Multani if your spouse is a us citizen, you're eligible to apply for  AOS + EAD using category C9 concurrently.... you may still submit them now.

 

Pros:

you get your EAD/work permit within 90 days (ONLY if you have a pending i485/AOS)

 

Cons:

If you do file for AOS with your vawa and the vawa  is denied you will be placed in removal proceedings.

I will apreciated your help Sandranj, I could not find my answer after reeding almost all the visajourney Vawa Part...

 

I field  I-360 oct 2015, was approved in Nov 2016

I field separately for AOS on February 2017.

 

On USCIS vawa section web cite  show watting time frame for I-360 but not for I-485 AOS.

 

 

how long is the watting time after filling I-485?

 

If I sent my I-485 to Vermont office, Is the case process at vermont office or local office (I live in Los Angeles)

 

What does vermont do with My AOS I-485 after receiving are they transfering my case somewhere?

Vermont sends it to the National Benefis Center and they send it to your local office who adjudicates it, so for processing times look at your local office I-485 processing times.

She is derivative of your l360 but  once approved your  VAWA she has to file for AOS

You must file form l485 with Vermont,  once they  receive the AOS  they will submit to NBC and NBC  will ship to the local office. The  local offices are taking  6/9months  to schedule an interview.
