Thank you so much for getting back to me, the reason why i am so worry is because i previously filled 485 based on marriage and had my work permit, my husband left and didnt show up to the interview i went to the interview and officer told me: "You are the kind of person i like to help to stay in this country so file for vawa" a month later i got the 485 denial letter and they canceled my work permit, does this has anything to do with this rfe? I am just so worry

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hello everyone,

 

I am getting ready to send off my Vawa paperwork after gathering as much info as I could find. 

My husband and were in an okay relationship, we knew it was bad but we stayed and try to make it work. But after we got married he physically abused me twice while pregnant along with verbal abuse. 

I have our daughters birth certificate...marriage license...letters from friends and family...referral from obgyn to psychologists.. letter from obgyn stating that I was a patient and suffered abuse from spouse...bank statements that shows his check being directly deposited in my account..credit card showing he is an authorized user.. little photos because he deleted practically everything out the phone since we were sharing a phone...a letter from the therapist but not a psychological evaluation. Please let me know what else I can use as well.

you don't need police clerance from the FBI for god sake, you need to go to the police station in yout State and ask a police clearance tand it will be ready in 48 hours, you must submit police clearance from all PLACES YOU LIVED IN THE PASR 3 YEARS,if you lived in that place over 6months.

 

USCIS will do the FBI background check,NOT YOU! you need a police clearance that hou have to get in the police station.

OK, I am back with additional questions as I have obtained more information than my first post.  

 

So my SIL stated that her GC was approved, but he refused to give it to her, so she does not know approval dates, was it a ten year gc, etc....  After several more months of physical abuse, she ran to a shelter where she stayed long enough to use the computer to buy her plane ticket and returned home which was in 2005.  She stated that she does not know anything else about her case after she returned home.  She believes that since she left, it was surrendered.  That is why she applied for H1 and Visitor's Visa, which is what she has now and has been here since 2015.  After further discussion, she does not have proof of divorce, but when she filed her 2015 taxes, she received a notice that they were taking money from her refund because of taxes owed when husband filed.  So that now has us believing that he has been filing taxes claiming her every year (Another call to an govt agency).  We checked with TX vital statistics from 2003 - 2015 and they do not show a record of their divorce.

 

Does she still file a SB-1 or can she file for VAWA since she left due the physical abuse, including a miscarriage due to the physical abuse.  I want to file FOIA to obtain her case records, is that the right thing to do? 

 

Thanks for your responses... She is going to be visiting us next month, so I want to at least begin on getting items together.

Last Friday my abusive us spouse trying to blind me by hurting my eyes by throwing an unknown chemical in my face, I went to the district courthouse today to obtain a copy of the incident then know the court date of the  hearing. There I realized that an unknown police officer had filed a charge against me that I assaulted him, threatened my wife and her daughter with a knife at her apartment, then speed off in a black SUV. And all this allegedly  happened two days after her abuse on me. Honestly I've never been there since my abuse and I'm currently living with my uncle about 45min away from her residence. I have a drivers license but I don't own a car or SUV. I don't know this police officer who claims me assaulting him in addition to my spouse. Two days after my assault I was home on medication for my eye burn and I was no where near her town or residence on this day they both claim I assaulted them. 

Please I need help trying to understand why all this happening to me because at the moment I'm falling into depression on why this lie on me. 

Please vj'ers, advise me on what to do next on all this hatred and false allegations. Please I'm begging you all in the name of God Almighty I need help.

I am sorry you're going through this, you must consult criminal attorney regarding this matter and keep all evidence of your own abuse and medical treatment!

Did you drive while your eyes were recovering? it may help if you didn't  and hopefully you have witnesses to confirm your claims in order to dismiss your spouse's false allegations. please note that I am only a community member trying to be supportive and offer advice or helpful suggestions but you still must seek legal assistance from a qualified lawyer asap to protect yourself.

@gramercyThanks for your response. I don't drive, own a car or even a bicycle. I have no insurance moreover to rent a car if that was the case. I was home all day and I live with my uncle so he's a witness that I was home. I couldn't even go to church because my eyes swollen and still recovering from her abuse.

Well that should help try to act fast & get a  lawyer to help you get those charges dismissed/dropped somehow.

Peru1234 calling Vermont will not make any difference. Try to submit the RFE answer within 30 days ok. You don't have to submit the FBI background check, it takes several months, just submit a police clearance from all places that you lived last 3 years.

You got a restraining order but did you file a police report regarding of what happened with you? did you go to the hospital?

@sandranjI spoke to a lawyer today and I'll be meeting up on Monday. Yes I did file a police report regarding my abuse with a court hearing date on Feb 28th. I went to Walgreen's then the pharmacist observed my eyes then prescribed eye moisturizer to help reduce the burn, and asked that if it's not getting better I should go the hospital but using it over these days had helped so I've not been to the hospital.
