Interjecting with a VJ site note here:  Captain Ewok, the site administrator, has set a strict 200-page limit on thread length.  This means that, pretty soon, we'll have to close this thread and start VAWA Part 9.  Just wanted everyone to be aware.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hello Everyone,

 

Just wondering about the reason behind not getting the prima facia till this moment 

 

I360 & I 485 received on April 25/2017  Notice date on 5/18/2017 fee are waived 

 

I got the EAD already a month ago

 

Anybody can tell me what it indication by not receiving the prima facia

I filed my VAWA on January 2016 and got prima facie. I have a prima facie extension given to me just this august 2016. My husband is a US citizen....

 

1.) What paperworks can I file to adjust my status? And get Employment card? 

 

2.) Is it a wise decision? Because i heard that if you do this and your VAWA not approved you will get deported?

Looking at current processing times on the USCIS website, it takes about 319 days at the moment. Calculate Notice Date (not receipt date!) + 319 days to get an estimate. Of course processing times can change, so this is not accurate but just an estimate.

The issue if prima facie solely depends on the officer who works on your case. Lots of members here got approved without prima facie. In other words, having a prima facie does not mean that your case will be approved.

@Cameron.xyz did u file 2016 or 2017? If 2016 and you have an extension of prima facie without your request, I suggest you make an infopass and inquire about your case. That's what happened to me, I filed May 2016. April 2017, I received the second prima facie although I did not request it. I came to an infopass ans found out my case was approved in March 2017.

Hello everybody, 

 

Have been a while I don't post here. My life changed  alot lately. I got remarried recentily ( not to  my ex abusive husband) before a decision of my VAWA petition. I know that for doing that, my petition will not more be vailid. My new husband is preparing the forms I-130, I-485 and I-765. I have some questions about it. First, should I send a letter to withdraw my VAWA petition before my new husband send his petition in my behalf? What can happen if he sends  his petition and they figure out that I had a pending VAWA petition? I ask because in the forms that we are filling they ask if I have an Alien number. I have one because of my petition and I puting there. Or should I not put my alien number on the new application?

 

Sandra, could you help me with these questions and anyone that can help. Thank you!

i dont know i got prima facie , my attroney knows about it 

all i know i got RFE in june and submitted in end of sep 2016

If you will file for I-130/I-485 then you should withdraw the VAWA petition. I hope you had a long Courtship because USCIS when adjudicating a new AOS based on a new marriage they have higher standards when adjudicating the AOS,after the alien filed VAWA.
