Quick question for all you nice folks at VJ:

I'm a Summer 2016 filer and just got RFE'd for GMC. We have just responded with clearance reports etc so there shouldn't be any issues there.

The question is, how long will it take for CIS to now issue a decision on the case? I know that there isn't a definitive time-frame, but you can inquire after 60 days. However, for a simple enough RFE such as GMC, how long should I reasonable anticipate?

Thank you all in advance.

I'm filing from abroad and I'm seeing a therapist in my home country. I checked with other therapists here and everyone is just as clueless. He said he can write a report if he had a guiding sample.

As far I know there is no "sample mental assessment" available. Perhaps someone who has had an evaluation done may be willing to block out some info and send you a copy of theirs? Its a lot to ask of someone though. Its also not very helpful to use someone elses assessment as each case is unique.

I know Sandra sometimes reviews assessments. She may be willing to take a look at what your therapist prepares and give you feedback.

Here is a pdf link about writing mental assessments for immigration. On the last few pages it gives a basic outline of what it should contain Perhaps it can help your Dr format something.

I can send to your psychologist  a sample, but he has to contact me by mail. I have authorization to disclose the evaluations with psychologists or counselors, not with you.

In  the summer 2016 you filed VAWA and they issued now the RFE,  this is good news, it seems you will have your case approved soon. They may give the decision within 20/30 days.

When someone files VAWA and right away USCIS  issues an RFE for good moral character, it doesn't mean the person will have the VAWA  case approved, but when USCIS issues an RFE after long time asking for just one kind of document  this is good news, because it shows that the officer got the case to adjudicate(to give a decision), and in your case he/she noticed the only thing  missing is  the police clearance.

Yes my husband molested her but the report says his actions were inapropiatte but did not elevate to sexual abuse ? That time We went to family court and I got a stay away order from the two of us. I'm going to scan the document and I'll email it to you is that ok?

Having a restraining order issued against you  is bad for a vawa case.

Did you file a motion  to rescind or modify the restraining order or did you file an appeal? If you didn't, then why not?

Did the court  issue a finding of molestation and not sexual  abuse? . I have to see the  Court  papers, I can't give my opinion without seeing the papers? I will  send my email through pm

Is your daughter attending therapy?

I see often people  who got married after  they received the NTA,  and later on the person was abused and file for VAWA. It's mandatory to submit along with the the VAWA documents a letter that you have to draft called "bonafide marriage exemption".You have to explain why you are seeking the exemption. You can draft something like this

                                                                             BONAFIDE  MARRIAGE EXEMPTION

August 11th, 2017

TO: USCIS

My name is xxxxx.I was born on xxxxx in xxxxx. I was  married to xxxxxxx (or I am married).

I was in  removal proceedings at the time of my marriage. I am requesting the bona fide marriage exemption based that I entered into  marriage with my husband (or ex husband/wife) in good faith  (enclosed documents).

We intended to establish a life together at the time of the marriage. The evidences  demonstrate that I  entered into marriage with my former husband(or wife) in good faith, as required by section 204(a)(1)(A)(iii)(I)(aa) of the Act. I meet the requirement  to establish eligibility for the exemption.

Very Truly Yours,
(name and signature
